Diese Nutzungsbedingungen für europäische Nutzer:innen („Nutzungsbedingungen“) stellen einen rechtlich bindenden Vertrag zwischen Ihnen und Airbnb dar, der Ihre Berechtigung zur Nutzung der Websites und Anwendungen sowie andere Angebote von Airbnb (zusammen die „Airbnb-Plattform“) regelt. Wenn in diesen Nutzungsbedingungen die Begriffe „Airbnb“, „wir“, „uns“ oder „unser“ verwendet werden, bezieht sich dies auf das in Anhang 1 aufgeführte Airbnb-Unternehmen, mit dem Sie einen Vertrag abschließen.

Die Airbnb-Plattform ist eine Online-Plattform, auf der Nutzer:innen („Mitglieder“) Services veröffentlichen, anbieten, suchen und buchen können. Mitglieder, die Services veröffentlichen und anbieten, sind „Gastgeber:innen“, und Mitglieder, die diese Services suchen, buchen oder nutzen, sind „Gäste“. Gastgeber:innen bieten Unterkünfte („Unterkünfte“), Aktivitäten, Ausflüge und Veranstaltungen („Entdeckungen“) sowie eine Vielzahl von Reise- und anderen Services an (zusammen „Gastgeber:innen-Services“; dabei umfasst jeder Gastgeber:innen-Service ein „Inserat“). Als Betreiber der Airbnb-Plattform ist Airbnb nicht Eigentümer, Anbieter oder Verwalter von Inseraten, Gastgeber:innen-Services oder Tourismus-Services. Airbnb ist weder Vertragspartner bei Verträgen, die direkt zwischen Gastgeber:innen und Gästen geschlossen werden, noch Immobilienmakler, Reisebüro, Versicherer, Veranstalter oder Vermittler von Pauschalreisen im Sinne der Richtlinie (EU) 2015/2302. Airbnb handelt in keiner Eigenschaft als Vertreter für Mitglieder, außer wie in den Zahlungsbedingungen („Zahlungsbedingungen“) angegeben. Mehr über die Rolle von Airbnb erfahren Sie in Ziffer 17.

Wir unterhalten weitere Bedingungen und Richtlinien, die diese Nutzungsbedingungen ergänzen, einschließlich unserer Datenschutzerklärung, die unsere Erhebung und Nutzung personenbezogener Daten beschreibt, und unserer Zahlungsbedingungen, die alle Zahlungsdienstleistungen regeln, welche den Mitgliedern von den Airbnb-Zahlungsunternehmen (zusammen „Airbnb Payments“) zur Verfügung gestellt werden.

Bedingungen für Gäste

1. Suchen und Buchen auf Airbnb.

1.1 Suche. Sie können nach Gastgeber:innen-Services suchen, indem Sie Kriterien wie die Art des Gastgeber:innen-Services, die Art des Inserats, das Reiseziel, die Reisedaten und die Anzahl der Gäste angeben. Sie können auch Filter verwenden, um Ihre Suchergebnisse zu verfeinern. Die Suchergebnisse basieren auf der Relevanz für Ihre Suche und weiteren Kriterien. Die Relevanz berücksichtigt Faktoren wie den Preis, die Verfügbarkeit, Bewertungen, die Support- und Stornierungshistorie, die Beliebtheit, frühere Reisen und gespeicherte Inserate, die Anforderungen des Gastgebers bzw. der Gastgeberin (z. B. Mindest- oder Höchstzahl an Nächten) und mehr. Weitere Informationen über die Suchergebnisse erhalten Sie unter Ziffer 5.3 und in unserem Hilfe-Center.

1.2 Buchung. Wenn Sie ein Inserat buchen, erklären Sie sich damit einverstanden, alle Gebühren für Ihre Buchung zu zahlen, einschließlich des Inseratspreises, anfallender Gebühren wie der Servicegebühren von Airbnb, Offline-Gebühren, Steuern und aller anderen Posten, die beim Bezahlvorgang angegeben werden (zusammen der „Gesamtpreis“). Wenn Sie sich dafür entscheiden, mit einer anderen als der vom Gastgeber bzw. von der Gastgeberin für sein/ihr Inserat festgelegten Währung zu bezahlen, basiert der Ihnen angezeigte Preis auf einem von uns festgelegten Währungsumrechnungskurs. Wenn Sie die Buchungsbestätigung erhalten, wird zwischen Ihnen und dem/der Gastgeber:in ein Vertrag über die Gastgeber:innen-Services (eine „Buchung“) abgeschlossen. Damit unterliegen Sie zusätzlich zu diesen Nutzungsbedingungen allen Bedingungen der Buchung – einschließlich und ohne Beschränkung der Stornierungsbedingungen und aller anderen Regeln, Standards, Richtlinien oder Anforderungen, die im Inserat oder beim Bezahlvorgang angegeben werden – und sind dafür verantwortlich, diese einzuhalten. Es liegt in Ihrer Verantwortung, diese Regeln, Standards, Richtlinien und Anforderungen zu lesen und zu verstehen, bevor Sie ein Inserat buchen. Bitte beachten Sie, dass einige Gastgeber:innen mit Co-Gastgeber:innen oder einem Team zusammenarbeiten, um ihre Gastgeber:innen-Services bereitzustellen.

1.3 Buchungen von Unterkünften. Die Buchung einer Unterkunft stellt ein Ihnen vom Gastgeber bzw. von der Gastgeberin eingeräumtes, eingeschränktes Recht dar, die Unterkunft zu betreten, zu bewohnen und zu nutzen. Der/Die Gastgeber:in ist berechtigt, die Unterkunft während Ihres Aufenthalts weiterhin zu betreten, soweit: (i) dies in angemessenem Rahmen erforderlich, (ii) durch Ihren Vertrag mit dem/der Gastgeber:in erlaubt und (iii) nach geltendem Recht zulässig ist. Wenn Sie nach dem vorgesehenen Check-out-Datum weiterhin in der Unterkunft verbleiben, hat der/die Gastgeber:in das Recht, Sie auf eine nach geltendem Recht zulässige Art und Weise zum Verlassen der Unterkunft aufzufordern, einschließlich der Geltendmachung von Mehrkosten, die dem/der Gastgeber:in durch Ihren längeren Aufenthalt entstehen. Sie dürfen die maximal zulässige Anzahl an Gästen nicht überschreiten.

1.4 Buchungen von Entdeckungen und anderen Gastgeber:innen-Services. Die Buchung einer Entdeckung oder eines anderen Gastgeber:innen-Services berechtigt Sie, an dieser Entdeckung oder diesem Gastgeber:innen-Service mitzuwirken, teilzunehmen oder sie/ihn zu nutzen. Sie und alle von Ihnen eingeladenen Personen müssen die Anforderungen hinsichtlich Mindestalter, Befähigung, Eignung sowie weitere Anforderungen des Gastgebers bzw. der Gastgeberin erfüllen. Sie sind verpflichtet, den/die Gastgeber:in über sämtliche Erkrankungen, körperlichen Zustände oder sonstigen Umstände zu informieren, die Ihre Fähigkeit beeinträchtigen könnten, an der Entdeckung oder dem Gastgeber:innen-Service teilzunehmen oder diese(n) zu nutzen. Sofern nicht ausdrücklich autorisiert, dürfen Sie keiner weiteren Person erlauben, an einer Entdeckung oder einem Gastgeber:innen-Service teilzunehmen, es sei denn, sie wird im Rahmen des Buchungsvorgangs als zusätzlicher Gast angegeben.

2. Stornierungen, Probleme mit Buchungen, Rückerstattungen und Buchungsänderungen.

2.1 Stornierungen, Probleme mit Buchungen und Rückerstattungen. Wenn Sie eine Buchung stornieren, richtet sich der Betrag, der Ihnen zurückerstattet wird, grundsätzlich nach den Stornierungsbedingungen des Gastgebers bzw. der Gastgeberin, die für die betreffende Buchung gelten. In bestimmten Situationen haben jedoch möglicherweise andere Richtlinien Vorrang und bestimmen, welcher Betrag Ihnen zurückerstattet wird. Wenn ein Umstand außerhalb Ihrer Kontrolle Sie zwingt, eine Buchung zu stornieren, haben Sie möglicherweise Anspruch auf eine anteilige oder vollständige Rückerstattung gemäß unseren Richtlinien für besondere Umstände. Wenn der/die Gastgeber:in storniert oder es ein Problem mit Ihrer Buchung gibt (wie in unserer Richtlinie für Umbuchungen und Rückerstattungen definiert), haben Sie möglicherweise Anspruch auf Unterstützung bei der Umbuchung oder auf eine anteilige oder vollständige Rückerstattung im Rahmen unserer Richtlinie für Umbuchungen und Rückerstattungen. Für bestimmte Kategorien von Inseraten gelten andere Richtlinien; zum Beispiel unterliegen Buchungen von Entdeckungen den Richtlinien für Rückerstattungen an Gäste von Entdeckungen. Einzelheiten dazu, was abgedeckt ist und wie hoch Ihre Rückerstattung in der jeweiligen Situation ausfällt, finden Sie in den jeweiligen zusätzlichen rechtlichen Bestimmungen oder Richtlinien. Sie können gegen eine Entscheidung von Airbnb Beschwerde einlegen, indem Sie sich an den Airbnb-Support wenden.

2.2 Änderungen von Buchungen. Gastgeber:innen und Gäste sind für alle Änderungen von Buchungen verantwortlich, die sie über die Airbnb-Plattform oder den Airbnb-Support vornehmen („Buchungsänderungen“), und sie verpflichten sich, alle zusätzlichen Beträge, Gebühren oder Steuern zu zahlen, die mit einer Buchungsänderung verbunden sind.

3. Ihre Verantwortlichkeiten.

Sie sind verantwortlich für Ihre eigenen Handlungen und Unterlassungen und sind auch verantwortlich für die Handlungen und Unterlassungen von Personen, die Sie einladen, sich der Buchung einer Unterkunft anzuschließen, oder denen Sie Zugang zur Unterkunft und allen Bereichen und Einrichtungen am Standort der Unterkunft gewähren, zu deren Nutzung der/die Gastgeber:in und der Gast im Zusammenhang mit der Unterkunft rechtlich befugt sind („Gemeinschaftsbereiche“), oder zu einer Entdeckung oder einem anderen Gastgeber:innen-Service. Dies bedeutet zum Beispiel Folgendes: (i) Sie sind dafür verantwortlich, eine Unterkunft (und damit zusammenhängendes persönliches Eigentum) oder Gemeinschaftsbereiche in dem Zustand zu hinterlassen, in dem Sie diese vorgefunden haben; (ii) Sie sind dafür verantwortlich, alle angemessenen Schadenersatzbeträge zu zahlen; und (iii) Sie müssen stets integer handeln, andere respektvoll behandeln und die geltenden Gesetze einhalten. Wenn Sie für zusätzliche Gäste buchen, die minderjährig sind, oder wenn Minderjährige Sie zu einem Gastgeber:innen-Service begleiten, müssen Sie rechtlich befugt sein, im Namen der Minderjährigen zu handeln, und Sie allein sind für die Beaufsichtigung dieser Minderjährigen verantwortlich.

Bedingungen für Gastgeber:innen

4. Gastgeben auf Airbnb.

4.1 Gastgeber:innen. Als Gastgeber:in erhalten Sie von Airbnb die Berechtigung, die Airbnb-Plattform gemäß diesen Nutzungsbedingungen zu nutzen, um unserer lebendigen Gäste-Community Ihre Unterkunft, Entdeckung oder einen anderen Gastgeber:innen-Service anzubieten – und sich so etwas dazuzuverdienen. Sie können ganz einfach ein Inserat erstellen und haben die Kontrolle darüber, wann und wie Sie Gäste aufnehmen. Sie legen Ihren Preis, Ihre Verfügbarkeit und Regeln für jedes Inserat selbst fest. Wenn Sie als gewerbliche:r Gastgeber:in gemäß Ziffer 26 tätig sind, gelten zusätzliche Bedingungen.

4.2 Verträge mit Gästen. Wenn Sie eine Buchungsanfrage bestätigen oder eine Buchungsbestätigung über die Airbnb-Plattform erhalten, schließen Sie einen Vertrag direkt mit dem Gast ab und sind dafür verantwortlich, den Gastgeber:innen-Service zu den Bedingungen und zu dem Preis zu erbringen, die in Ihrem Inserat angegeben sind. Außerdem sind Sie dafür verantwortlich, sämtliche anfallenden Gebühren wie die Servicegebühr von Airbnb (und anfallende Steuern) für jede Buchung zu zahlen. Airbnb Payments wird diese Beträge von Ihren Auszahlungen abziehen, es sei denn, wir einigen uns mit Ihnen auf eine andere Vorgehensweise. Alle Bedingungen oder Bestimmungen, die Sie in einen etwaigen Zusatzvertrag mit Gästen aufnehmen, müssen: (i) mit diesen Nutzungsbedingungen, unseren

zusätzlichen vertraglichen Bestimmungen, unseren Richtlinien und den in Ihrem Inserat bereitgestellten Informationen übereinstimmen und (ii) in Ihrer Inseratsbeschreibung deutlich angegeben werden.

4.3 Unabhängigkeit von Gastgeber:innen. Ihr Verhältnis zu Airbnb ist das einer unabhängigen natürlichen oder juristischen Person und nicht das eines Mitarbeiters bzw. einer Mitarbeiterin, eines Vertreters bzw. einer Vertreterin, eines Mitunternehmers bzw. einer Mitunternehmerin oder eines Partners bzw. einer Partnerin von Airbnb, mit der Ausnahme, dass Airbnb Payments, wie in den Zahlungsbedingungen beschrieben, als Zahlungsabwickler fungiert. Airbnb steuert oder kontrolliert Ihren Gastgeber:innen-Service nicht, und Sie entscheiden nach eigenem Ermessen, ob und wann Sie Gastgeber:innen-Services anbieten und zu welchem Preis und zu welchen Bedingungen dies geschieht.

5. Verwaltung Ihres Inserats.

5.1 Erstellung und Verwaltung Ihres Inserats. Die Airbnb-Plattform stellt Tools zur Verfügung, mit denen Sie ganz einfach ein Inserat erstellen und verwalten können. Ihr Inserat muss vollständige und genaue Informationen über Ihren Gastgeber:innen-Service, Ihren Preis, andere Gebühren wie Reinigungsgebühren, Gebühren für sonstige Leistungen, außerhalb der Plattform erhobene Gebühren und sämtliche Bedingungen oder Anforderungen enthalten, die für Ihre Gäste oder Ihr Inserat gelten. Sie sind verantwortlich für Ihre Handlungen und Unterlassungen sowie dafür, dass die Angaben in Ihrem Inserat (einschließlich der Verfügbarkeiten im Kalender) sowie die Inhalte (beispielsweise Fotos) stets aktuell und korrekt sind. Sie sind dafür verantwortlich, eine angemessene Versicherung für Ihre Gastgeber:innen-Services abzuschließen, und wir empfehlen Ihnen, die Versicherungsbedingungen, einschließlich der Versicherungsdetails und -ausschlüsse, sorgfältig zu prüfen. Sie dürfen pro Unterkunft nur ein Inserat erstellen. Sie können jedoch mehrere Inserate für eine einzelne Immobilie erstellen, wenn in dieser mehrere Unterkünfte vorhanden sind. Jede angebotene Entdeckung unterliegt unseren zusätzlichen Bedingungen für Gastgeber:innen von Entdeckungen.

5.2 Machen Sie sich mit Ihren rechtlichen Verpflichtungen vertraut. Sie sind selbst für die Ermittlung und Einhaltung aller Gesetze, Regeln, Vorschriften und Verträge mit Dritten verantwortlich, die für Ihr Inserat oder Ihre Gastgeber:innen-Services gelten. Zum Beispiel: Einige Vermieter:innen oder Wohnungseigentümergemeinschaften beschränken oder verbieten Untervermietungen, Kurzzeitvermietungen und/oder längere Aufenthalte. In einigen Städten gelten Bauplanungsvorschriften oder andere Gesetze, die die kurzfristige Vermietung von Wohnimmobilien einschränken. An einigen Standorten müssen sich Gastgeber:innen registrieren, eine Genehmigung einholen oder eine Erlaubnis erhalten, bevor sie bestimmte Gastgeber:innen-Services anbieten (z. B. Kurzzeitvermietungen, längere Aufenthalte, Zubereitung von Speisen, Verkauf alkoholischer Getränke, geführte Touren oder der Betrieb eines Fahrzeugs). An manchen Standorten sind die Gastgeber:innen-Services, die Sie anbieten möchten, vielleicht gänzlich verboten. An einigen Standorten wird verlangt, dass Sie Gäste registrieren, die in Ihrer Unterkunft übernachten. An einigen Standorten gibt es Gesetze, die Mieter:innenrechte für Gäste und zusätzliche Verpflichtungen für Gastgeber:innen vorsehen. Zum Beispiel gibt es in einigen Orten Mietrechte sowie Mietstabilisierungs- und Räumungsgesetze, die für längere Aufenthalte relevant sein können. Bitte prüfen Sie die Gesetzeslage bei Ihnen vor Ort, um zu erfahren, welche Vorschriften für die Gastgeber:innen-Services gelten, die Sie anbieten möchten. Informationen, die wir in Bezug auf gesetzliche Anforderungen zur Verfügung stellen, dienen lediglich Informationszwecken, und Sie sollten sich Ihre Verpflichtungen unabhängig bestätigen lassen. Sie sind dafür verantwortlich, personenbezogene Daten von Gästen und anderen Personen in Übereinstimmung mit den geltenden Datenschutzgesetzen und diesen Nutzungsbedingungen, einschließlich unserer Datenschutz-Standards für Gastgeber:innen, zu behandeln und zu verwenden. Wenn Sie Fragen zur Anwendung der örtlichen Gesetze haben, sollten Sie sich immer rechtlich beraten lassen.

5.3 Suchergebnisse. Die Reihenfolge und Anzeige der Inserate in den Suchergebnissen auf der Airbnb-Plattform hängt von einer Vielzahl von Faktoren ab, darunter diesen Hauptparametern:

  • Suchparameter des Gastes (z. B. Anzahl der Gäste, Reiseziel, Reisezeit und -dauer, Preisspanne);
  • Merkmale des Inserats (z. B. Lage, Preis, Verfügbarkeit im Kalender, Anzahl und Qualität der Bilder, Bewertungen und andere Qualitätssignale, Art oder Kategorie des Gastgeber:innen-Services, Status des Gastgebers bzw. der Gastgeberin, Zeitspanne seit der Veröffentlichung des Inserats auf der Airbnb-Plattform, Interaktion von Gästen sowie Beliebtheit bei Gästen);
  • Erfahrungen, die Gäste machen (z. B. Support- und Stornierungshistorie des Gastgebers bzw. der Gastgeberin, Einfachheit der Buchung);
  • Anforderungen des Gastgebers bzw. der Gastgeberin und des Inserats (z. B. Mindest- oder Höchstzahl an Nächten, Buchungsfrist); und
  • Präferenzen und Historie des Gastes (z. B. frühere Reisen, angeschaute und gespeicherte Inserate, Ort, von dem aus der Gast sucht).

Die Suchergebnisse in unserer mobilen App werden möglicherweise anders angezeigt als auf unserer Website und können sich auch in der Kartenansicht unterscheiden. Airbnb behält sich vor, es Gastgeber:innen zu ermöglichen, ihre Inserate in der Suche oder anderswo auf der Airbnb-Plattform zu bewerben, indem sie eine zusätzliche Gebühr zahlen. Weitere Informationen über die Faktoren, die bestimmen, wie Ihr Inserat in den Suchergebnissen angezeigt wird, unsere aktuellen Werbeprogramme (falls vorhanden) und Informationen, wie wir beworbene Inhalte identifizieren, finden Sie in unserem Hilfe-Center.

5.4 Ihre Verantwortlichkeiten. Sie sind verantwortlich für Ihre eigenen Handlungen und Unterlassungen und sind auch verantwortlich für die Handlungen und Unterlassungen von Personen, die an der Durchführung Ihrer Gastgeber:innen-Services mitwirken. Sie sind dafür verantwortlich, Ihren Preis festzulegen und Regeln und Anforderungen für Ihr Inserat zu erstellen. Sie müssen alle Gebühren und Kosten in Ihrer Inseratsbeschreibung angeben und dürfen keine zusätzlichen Gebühren oder Gelder außerhalb der Airbnb-Plattform einziehen, mit Ausnahme solcher, die ausdrücklich durch unsere Richtlinien für außerhalb der Plattform gezahlte Gebühren gestattet sind. Sie dürfen Gäste nicht auffordern oder ermutigen, außerhalb der Airbnb-Plattform Airbnb-Konten zu erstellen, Bewertungen abzugeben, ihre Kontaktdaten anzugeben oder andere Maßnahmen zu ergreifen, die gegen unsere Richtlinien für Handlungen außerhalb der Plattform verstoßen.

5.5 Gastgeben als Team oder Organisation. Wenn Sie als Teil eines Teams, Unternehmens oder einer anderen Organisation tätig sind oder mit einem/einer Co-Gastgeber:in zusammenarbeiten, sind Sie als Gastgeber:in im Rahmen dieser Nutzungsbedingungen verantwortlich und haftbar für die Handlungen und Unterlassungen jeder juristischen und natürlichen Person, die mit Ihnen an der Erbringung von Gastgeber:innen-Services für jedes Ihrer Inserate beteiligt ist, und Sie sind verpflichtet, das von Ihnen mit der Erbringung von Gastgeber:innen-Services beauftragte Personal über Ihre Verpflichtungen gemäß diesen Nutzungsbedingungen zu informieren. Wenn Sie Bedingungen zustimmen oder Verträge abschließen, bestätigen Sie, dass Sie ermächtigt sind, Verträge für Ihr Team, Unternehmen oder Ihre sonstige Organisation abzuschließen und diese zu verpflichten. Wenn Sie andere Funktionen ausüben, versichern Sie, dass Sie ermächtigt sind, diese Funktionen auszuüben. Wenn Sie Airbnb anweisen, einen Teil Ihrer Auszahlung an eine:n Co-Gastgeber:in oder sonstige:n Gastgeber:in zu übermitteln oder Zahlungen an eine andere Person zu senden, müssen Sie dazu autorisiert sein und sind verantwortlich für die Zahlungsbeträge und die Richtigkeit der von Ihnen bereitgestellten Auszahlungsinformationen.

6. Stornierungen, Probleme mit Buchungen und Buchungsänderungen.

6.1 Stornierungen und Probleme mit Buchungen. Wenn ein Gast eine Buchung storniert, wird der an Sie gezahlte Betrag grundsätzlich durch Ihre Stornierungsbedingungen bestimmt, die für diese Buchung gelten. Als Gastgeber:in sollten Sie Buchungen von Gästen nicht ohne gültigen Grund gemäß unseren Richtlinien für besondere Umstände oder geltendem Recht stornieren. Wenn Sie die Buchung eines Gastes ohne gültigen Grund stornieren, können wir eine Stornierungsgebühr erheben und weitere Maßnahmen ergreifen. Wenn (i) bei der Buchung eines Gastes ein Problem auftritt (wie in der Richtlinie für Umbuchungen und Rückerstattungen definiert), (ii) besondere Umstände auftreten oder (iii) eine Buchung gemäß Ziffer 13 dieser Nutzungsbedingungen storniert wird, wird der Betrag, der an Sie ausgezahlt wird, um den Betrag, den wir dem Gast erstatten oder anderweitig zur Verfügung stellen, sowie um alle weiteren angemessenen Kosten, die uns infolge der Stornierung entstehen, reduziert. Wenn ein Gast eine Rückerstattung erhält, nachdem Sie bereits bezahlt wurden, oder der Betrag der Rückerstattung sowie weitere Kosten, die Airbnb entstanden sind, Ihre Auszahlung übersteigen, kann Airbnb (über Airbnb Payments) diesen Betrag von Ihnen zurückfordern, auch durch Abzug der Rückerstattung von Ihren zukünftigen Auszahlungen. Unsere Richtlinie für Umbuchungen und Rückerstattungen, unsere Richtlinien für besondere Umstände und diese Nutzungsbedingungen haben Vorrang vor den von Ihnen festgelegten Stornierungsbedingungen in Situationen, in denen sie die Stornierung einer Buchung und/oder Rückerstattungen an Gäste vorsehen. Wenn wir berechtigterweise erwarten können, dass einem Gast im Rahmen einer dieser Richtlinien eine Rückerstattung zu gewähren ist, kann die Auszahlung für diese Buchung verzögert werden, bis eine Entscheidung bezüglich der Rückerstattung getroffen wurde. Wenn Sie Gastgeber:in einer Entdeckung sind, beachten Sie bitte, dass die Stornierungsbedingungen für Entdeckungen, die Richtlinien für Rückerstattungen an Gäste von Entdeckungen und andere Stornierungsgebühren und Konsequenzen für Ihre Buchungen gelten. Einzelheiten zu den Bestimmungen und dazu, welche Auszahlung in der jeweiligen Situation ausgegeben wird, finden Sie in den jeweiligen Richtlinien. Sie können gegen eine von Airbnb getroffene Entscheidung Beschwerde einlegen, indem Sie sich an den Airbnb-Support wenden.

6.2 Änderungen von Buchungen. Gastgeber:innen und Gäste sind für alle Buchungsänderungen verantwortlich, die sie über die Airbnb-Plattform oder den Airbnb-Support vornehmen, und verpflichten sich, alle zusätzlichen Beträge, Gebühren oder Steuern zu zahlen, die mit einer Buchungsänderung verbunden sind.

7. Steuern.

7.1 Steuern für Gastgeber:innen. Als Gastgeber:in sind Sie dafür verantwortlich, Ihren nach geltendem Recht bestehenden Verpflichtungen nachzukommen, geltende Umsatzsteuern oder andere indirekte Steuern, Belegungssteuern, Touristen-, Einkommens- oder sonstige Steuern („Steuern“) ordnungsgemäß zu melden, einzuziehen, abzuführen oder in Ihren Preis einzubeziehen.

7.2 Einzug und Abführung durch Airbnb. An Standorten, an denen Airbnb die Einziehung und/oder Abführung von Steuern im Namen von Gastgeber:innen durchführt, beauftragen und ermächtigen Sie Airbnb, die Steuern in Ihrem Namen einzuziehen und/oder an die zuständige Steuerbehörde abzuführen. Alle Steuern, die von Airbnb eingezogen und/oder abgeführt werden, werden Mitgliedern in ihren Transaktionsaufzeichnungen angezeigt. Airbnb kann zusätzliche Beträge von Mitgliedern einfordern (unter anderem durch Abzug solcher Beträge von zukünftigen Auszahlungen), falls die eingezogenen und/oder abgeführten Steuern nicht ausreichen, um die Steuerpflichten dieser Mitglieder vollständig zu erfüllen. Bei Widersprüchen gegen eingezogene Steuern sowie bei der Geltendmachung von Erstattungen müssen Sie sich an die jeweils zuständige Steuerbehörde wenden. Wir behalten uns das Recht vor, jederzeit nach vorheriger Benachrichtigung der betroffenen Mitglieder die Einziehung und Abführung von Steuern an jedem Standort einzustellen.

7.3 Steuerinformationen. In bestimmten Rechtsordnungen können wir aufgrund steuerlicher Bestimmungen verpflichtet sein, steuerliche Informationen über Sie einzuholen und/oder zu melden und/oder Steuern von Auszahlungen an Sie einzubehalten. Sollten Sie versäumen, uns die gesetzlich erforderlichen Unterlagen vorzulegen, die erforderlich sind, eine solche Verpflichtung, Steuern von Auszahlungen an Sie einzubehalten, zu belegen, können wir Auszahlungen bis zu dem gesetzlich vorgeschriebenen Betrag einbehalten, bis ausreichende Unterlagen vorgelegt werden. Sie stimmen zu, dass Airbnb in Ihrem Namen Rechnungen oder ähnliche Nachweise über Umsatzsteuer, GST, Verbrauchs- oder sonstige Steuern für Ihre Gastgeber:innen-Services ausstellen kann, um eine korrekte Steuerberichterstattung zu ermöglichen.

Allgemeine Bedingungen

8. Bewertungen.

Im Anschluss an jeden Gastgeber:innen-Service haben Gäste und Gastgeber:innen die Möglichkeit, sich gegenseitig zu bewerten. Ihre Bewertung muss zutreffend sein und darf keine diskriminierenden, beleidigenden, verleumderischen oder sonstigen Formulierungen enthalten, die gegen diese Bedingungen, geltendes Recht, unsere Richtlinien für angemessene Inhalte oder unsere Richtlinien für Bewertungen verstoßen. Bewertungen werden von Airbnb nicht auf ihre Richtigkeit überprüft und können unzutreffend oder irreführend sein.

9. Inhalte.

Teile der Airbnb-Plattform ermöglichen Ihnen, Feedback, Texte, Fotos, Audiodateien, Videos, Informationen und weitere Inhalte (zusammen „Inhalte“) bereitzustellen. Durch die Bereitstellung von Inhalten, in welcher Form und mit welchen Mitteln auch immer, gewähren Sie Airbnb eine nicht exklusive, weltweite, lizenzgebührenfreie, unterlizenzierbare und übertragbare Lizenz, für die Dauer des Schutzes der so lizenzierten Rechte, auf diese Inhalte zuzugreifen, sie zu verwenden, zu speichern, zu kopieren, zu ändern, zu modifizieren, abgeleitete Werke davon zu erstellen, zu verteilen, zu veröffentlichen, zu übertragen, zu streamen, zu senden und anderweitig in irgendeiner Weise zu nutzen, um die Airbnb-Plattform in allen bekannten oder bisher unbekannten Medien oder Plattformen, insbesondere im Internet und in sozialen Netzwerken, bereitzustellen und/oder zu bewerben. Wenn Inhalte personenbezogene Daten enthalten, werden diese nur für Zwecke verwendet, die datenschutzrechtlich zulässig sind; für unsere Verarbeitung solcher Inhalte gilt unsere Datenschutzerklärung. In Fällen, in denen Airbnb für die Erstellung von Inhalten bezahlt oder deren Erstellung unterstützt, kann Airbnb Rechteinhaber dieser Inhalte sein; in diesem Fall wird dies in zusätzlichen Bedingungen oder Offenlegungen erwähnt. Sie allein sind verantwortlich für alle Inhalte, die Sie bereitstellen, und stellen sicher, dass Sie entweder Rechteinhaber dieser Inhalte oder ermächtigt sind, Airbnb die in diesen Nutzungsbedingungen beschriebenen Rechte einzuräumen. Sie sind verantwortlich, wenn Ihre Inhalte das geistige Eigentum, die Persönlichkeitsrechte oder Datenschutzrechte Dritter verletzen. Inhalte müssen unseren Richtlinien für angemessene Inhalte und unserer Antidiskriminierungs-Richtlinie entsprechen, die unter anderem diskriminierende, obszöne, belästigende, betrügerische, gewalttätige und illegale Inhalte verbieten. Airbnb kann Dienste oder automatisierte Tools zur Übersetzung von Inhalten zur Verfügung stellen, und Sie stimmen zu, dass Ihre Inhalte mithilfe dieser Dienste oder Tools übersetzt werden können. Airbnb übernimmt keine Gewähr für die Richtigkeit oder Qualität von Übersetzungen, und die Mitglieder sind für die Überprüfung der Richtigkeit solcher Übersetzungen selbst verantwortlich.

10. Gebühren.

Airbnb kann von Gastgeber:innen und Gästen Gebühren (und geltende Steuern) für die Berechtigung zur Nutzung der Airbnb-Plattform erheben. Jegliche geltenden Gebühren werden Gastgeber:innen vor der Veröffentlichung eines Inserats und Gästen vor dem Abschluss einer Buchung angezeigt. Weitere Informationen dazu, wann Servicegebühren anfallen und wie diese berechnet werden, finden Sie auf unserer Seite zum Thema Servicegebühren. Sofern auf der Airbnb-Plattform nichts anderes angegeben wird, sind Servicegebühren nicht erstattungsfähig.

11. Regeln der Airbnb-Plattform.

11.1 Regeln. Sie müssen diese Regeln befolgen und dürfen anderen nicht helfen oder sie dazu verleiten, diese Regeln zu brechen oder zu umgehen.

  • Handeln Sie integer und behandeln Sie andere respektvoll.
    • Lügen Sie nicht, stellen Sie etwas oder jemanden nicht falsch dar und geben Sie nicht vor, jemand anderes zu sein.
    • Seien Sie im Umgang mit anderen höflich und respektvoll.
    • Versuchen Sie nicht, die Durchsetzung dieser Nutzungsbedingungen, unserer zusätzlichen vertraglichen Bedingungen, Richtlinien und Standards zu umgehen, indem Sie beispielsweise duplizierte Konten oder Inserate erstellen.
    • Befolgen Sie unsere Antidiskriminierungs-Richtlinie und diskriminieren oder belästigen Sie andere nicht.
  • Die Airbnb-Plattform darf nicht beschädigt, gehackt, nachgebaut, kompromittiert oder beeinträchtigt werden.
    • Verwenden Sie keine Bots, Crawler, Scraper oder andere automatisierte Mittel, um auf die Airbnb-Plattform zuzugreifen oder Daten oder andere Inhalte von der Airbnb-Plattform zu erheben oder anderweitig mit ihr zu interagieren.
    • Sie dürfen nicht versuchen, Sicherheits- oder technologische Maßnahmen zum Schutz der Airbnb-Plattform oder der Inhalte zu umgehen, indem sie diese hacken, umgehen, deaktivieren, stören oder anderweitig unterlaufen.
    • Sie dürfen keine Software oder Hardware, die zur Bereitstellung der Airbnb-Plattform verwendet wird, entschlüsseln, dekompilieren, disassemblieren oder zurückentwickeln.
    • Ergreifen Sie keine Maßnahmen, die die Leistung oder ordnungsgemäße Funktionsweise der Airbnb-Plattform beschädigen oder beeinträchtigen könnten.
  • Nutzen Sie die Airbnb-Plattform nur so, wie durch diese Nutzungsbedingungen oder eine andere Vereinbarung mit uns autorisiert.
    • Sie dürfen die personenbezogenen Daten eines anderen Mitglieds nur dann verwenden, wenn dies erforderlich ist, um eine Transaktion über die Airbnb-Plattform zu ermöglichen, wie durch diese Nutzungsbedingungen autorisiert.
    • Nutzen Sie die Airbnb-Plattform, unsere Messaging-Tools oder die personenbezogenen Daten von Mitgliedern nicht, um kommerzielle Nachrichten ohne deren ausdrückliche Zustimmung zu senden.
    • Sie dürfen Inhalte, die über die Airbnb-Plattform zur Verfügung gestellt werden, nur dann verwenden, wenn dies erforderlich ist, um Ihnen die Nutzung der Airbnb-Plattform als Gast oder Gastgeber:in zu ermöglichen.
    • Nutzen Sie Inhalte nur, wenn Sie die Erlaubnis des Rechteinhabers / der Rechtsinhaberin dieser Inhalte haben oder die Nutzung von uns in diesen Nutzungsbedingungen oder einer anderen Vereinbarung, die Sie mit uns getroffen haben, autorisiert ist.
    • Sie dürfen keine Buchungen oder Zahlungen außerhalb der Airbnb-Plattform anfordern, durchführen oder entgegennehmen, um Gebühren oder Steuern zu umgehen oder aus anderen Gründen. Ausnahmen finden Sie in unseren Richtlinien für außerhalb der Plattform erhobene Gebühren.
    • Fordern Sie Gäste nicht auf, vor, während oder nach einer Buchung ein Nutzerkonto zu eröffnen, eine Bewertung abzugeben oder anderweitig mit einer Website, einer App oder einem Service Dritter zu interagieren, es sei denn, dies wurde von Airbnb genehmigt.
    • Führen Sie keine Maßnahmen durch, die darauf abzielen, unseren Suchalgorithmus zu manipulieren.
    • Buchen Sie Gastgeber:innen-Services nur, wenn Sie diese tatsächlich nutzen.
    • Sie dürfen die Airbnb-Plattform sowie jegliche Inhalte, Airbnb-Brandings, Seitenlayouts oder Designs ohne unsere Zustimmung nicht nutzen, kopieren, anzeigen, spiegeln oder manipulieren.
  • Erfüllen Sie Ihre gesetzlichen Pflichten.
    • Befolgen Sie stets die für Sie geltenden Gesetze, einschließlich der Gesetze zum Schutz der Privatsphäre sowie Datenschutz- und Exportgesetze.
    • Wenn Sie uns personenbezogene Daten einer anderen Person zur Verfügung stellen, müssen Sie: (i) dies in Übereinstimmung mit geltendem Recht tun, (ii) dazu ermächtigt sein und (iii) uns autorisieren, diese Informationen im Rahmen unserer Datenschutzerklärung zu verarbeiten.
    • Lesen und befolgen Sie unsere Nutzungsbedingungen, zusätzlichen vertraglichen Bedingungen, Richtlinien und Standards.
    • Organisieren oder ermöglichen Sie keine unautorisierten Partys oder Veranstaltungen. Sie sind verantwortlich für jede Party oder Veranstaltung während Ihres Aufenthalts, die gegen unsere Richtlinien für Partys und Veranstaltungen verstößt.
    • Nutzen Sie den Namen, das Logo, das Branding oder die Marken von Airbnb oder anderen nicht ohne Erlaubnis und nur so, wie in unseren Richtlinien für Markenzeichen beschrieben.
    • Verwenden oder registrieren Sie keine Domainnamen, Social-Media-Handles, Handelsnamen, Marken, Brandings, Logos oder andere Quellenkennungen, die den Marken, Logos oder Brandings von Airbnb zum Verwechseln ähnlich sind. Weitere Informationen finden Sie in unseren Richtlinien für Markenzeichen.
    • Bieten Sie keine Gastgeber:innen-Services an, die gegen die für Sie geltenden Gesetze oder Verträge verstoßen.
    • Bieten Sie weder Prostitution an, noch nehmen Sie diese in Anspruch; beteiligen Sie sich nicht am Menschenhandel und ermöglichen Sie ihn nicht.

11.2 Melden von Verstößen. Wenn Sie der Meinung sind, dass ein Mitglied, Inserat oder Inhalt ein unmittelbares Risiko für eine Person oder Unterkunft darstellt, wenden Sie sich umgehend an die örtlichen Behörden, bevor Sie Airbnb kontaktieren. Wenn Sie außerdem der Meinung sind, dass ein Mitglied, Inserat oder Inhalt gegen unsere Standards verstößt, sollten Sie Airbnb Ihre Bedenken mitteilen. Wenn Sie den örtlichen Behörden ein Problem gemeldet haben, kann Airbnb eine Kopie dieses Berichts anfordern. Sofern nicht gesetzlich vorgeschrieben, sind wir nicht verpflichtet, als Reaktion auf einen Bericht Maßnahmen zu ergreifen.

12. Inhaltsmeldungen und Inhaltsmoderation.

12.1 Sie erkennen an, dass Airbnb nicht allgemein verpflichtet ist, von Mitgliedern bereitgestellte und im Namen von Mitgliedern gespeicherte Inhalte zu überwachen oder aktiv nach Fakten oder Umständen zu suchen, die auf rechtswidrige Aktivitäten oder die Unvereinbarkeit von Inhalten mit den Rechten Dritter, diesen Nutzungsbedingungen oder den Richtlinien und Standards von Airbnb hinweisen. Airbnb behält sich jedoch das Recht vor, auf eigene Initiative freiwillige Untersuchungen durchzuführen, um rechtswidrige oder inkompatible Inhalte zu ermitteln, zu identifizieren und den Zugang zu ihnen zu entfernen oder zu sperren, und alle erforderlichen Maßnahmen gemäß diesen Nutzungsbedingungen zu ergreifen.

12.2 Sie erklären sich bereit, mit Airbnb in gutem Glauben zusammenzuarbeiten, Airbnb zu unterstützen und Airbnb die Informationen zur Verfügung zu stellen sowie die Maßnahmen zu ergreifen, die von Airbnb in Bezug auf eine von Airbnb durchgeführte Untersuchung hinsichtlich der Inhalte auf der Airbnb-Plattform oder der Nutzung oder des Missbrauchs der Airbnb-Plattform in angemessener Weise verlangt werden können.

12.3 Airbnb bietet Mitgliedern und Dritten, einschließlich der gemäß Artikel 22 der Verordnung (EU) 2022/2065 benannten vertrauenswürdigen Hinweisgeber („Hinweisgeber“), die Möglichkeit, Airbnb über mutmaßlich rechtswidrige Inhalte (einschließlich Urheberrechtsverletzungen) auf der Airbnb-Plattform zu informieren, indem sie unser elektronisches Meldeformular verwenden („Inhaltsmeldung“). Mehr darüber, wie Sie Inhalte melden können, erfahren Sie in unserem Hilfe-Center.

12.4 Im Rahmen von Untersuchungen auf eigene Initiative und der Überprüfung von Inhaltsmeldungen verwendet Airbnb verschiedene Prozesse und Tools, um Inhalte zu identifizieren, zu überprüfen und zu moderieren. Dies kann eine menschliche Überprüfung, eine automatische Überprüfung oder eine Kombination aus beidem beinhalten. Wenn automatisierte Mittel zur Überprüfung von Inhalten eingesetzt wurden und Airbnb daraufhin Maßnahmen in Bezug auf diese Inhalte ergriffen hat, wird Airbnb das Mitglied, das die Inhalte veröffentlicht hat, über den Einsatz automatisierter Mittel informieren, soweit die berechtigten Interessen von Airbnb und seinen Mitgliedern einer solchen Benachrichtigung nicht entgegenstehen.

12.5 Missbrauch von Inhaltsmeldungen. Airbnb ist berechtigt, die Verarbeitung von Inhaltsmeldungen für einen angemessenen Zeitraum auszusetzen, wenn der/die betreffende Hinweisgeber:in häufig Meldungen übermittelt, die offensichtlich unbegründet sind. Gegebenenfalls wird Airbnb vor einer solchen Aussetzung eine Warnung aussprechen. Bei der Entscheidung über eine Aussetzung berücksichtigt Airbnb alle relevanten Tatsachen und Umstände, die aus den Airbnb vorliegenden Informationen hervorgehen, einschließlich (i) des Umfangs, der Schwere und der Häufigkeit der unbegründeten Meldungen; (ii) des Verhältnisses der unbegründeten Meldungen zu allen Meldungen des Hinweisgebers bzw. der Hinweisgeberin; und (iii) der vom Hinweisgeber bzw. von der Hinweisgeberin verfolgten Absichten, soweit sie von Airbnb ermittelt werden können.

13. Kündigung, Suspendierung und andere Maßnahmen.

13.1 Laufzeit. Der Vertrag zwischen Ihnen und Airbnb, der sich in diesen Nutzungsbedingungen widerspiegelt, bleibt solange in Kraft, bis entweder Sie oder wir den Vertrag gemäß diesen Nutzungsbedingungen kündigen.

13.2 Kündigung. Sie können diesen Vertrag jederzeit kündigen, indem Sie uns eine E-Mail senden oder Ihr Airbnb-Konto löschen. Airbnb kann diesen Vertrag jederzeit mit einer Kündigungsfrist von 30 Tagen per E-Mail oder unter Verwendung sonstiger Kontaktdaten, die Sie für Ihr Airbnb-Konto angegeben haben, kündigen. Airbnb kann diesen Vertrag auch fristlos und ohne Vorankündigung kündigen und die Bereitstellung des Zugangs zur Airbnb-Plattform einstellen, wenn (i) Sie in erheblichem Maße gegen Ihre Pflichten aus diesen Nutzungsbedingungen oder unseren zusätzlichen rechtlichen Bestimmungen oder unseren Richtlinien verstoßen, (ii) Sie gegen geltendes Recht verstoßen oder (iii) eine solche Maßnahme notwendig ist, um die persönliche Sicherheit oder das Eigentum von Airbnb, seinen Mitgliedern oder Dritten zu schützen (zum Beispiel im Falle von betrügerischem Verhalten eines Mitglieds) oder (iv) Ihr Airbnb-Konto seit mehr als zwei Jahren inaktiv ist.

13.3 Verstöße von Mitgliedern. Wenn (i) Sie gegen diese Nutzungsbedingungen, unsere zusätzlichen rechtlichen Bestimmungen, unsere Richtlinien oder unsere Standards verstoßen; (ii) Sie gegen geltendes Recht, Vorschriften oder Rechte Dritter verstoßen; (iii) Sie Inhalte bereitstellen, die illegal oder mit diesen Nutzungsbedingungen unvereinbar sind; (iv) Sie wiederholt schlechte Bewertungen erhalten haben oder Airbnb auf andere Weise Beschwerden über Ihre Leistung oder Ihr Verhalten erhält oder davon erfährt; (v) Sie wiederholt bestätigte Buchungen storniert oder Buchungsanfragen ohne triftigen Grund nicht beantwortet haben; oder (vi) eine solche Maßnahme erforderlich ist, um die persönliche Sicherheit oder das Eigentum von Airbnb, seinen Mitgliedern oder Dritten zu schützen oder um Betrug oder anderen rechtswidrigen Aktivitäten vorzubeugen, kann Airbnb:

  • Ihren Zugriff auf die oder Ihre Nutzung der Airbnb-Plattform und/oder Ihres Airbnb-Kontos sperren oder einschränken;
  • den Zugriff auf Inserate, Bewertungen oder andere Inhalte aussetzen, entfernen, deaktivieren oder deren Sichtbarkeit einschränken;
  • ausstehende oder bestätigte Buchungen stornieren; oder
  • einen mit Ihrem Airbnb-Konto verknüpften besonderen Status vorübergehend oder dauerhaft widerrufen.

Bei nicht wesentlichen Verstößen oder wenn anderweitig möglich und angemessen, erhalten Sie von Airbnb eine Benachrichtigung über jede beabsichtigte Maßnahme und die Möglichkeit, das Problem zu beheben, es sei denn, eine solche Benachrichtigung würde (i) die Aufdeckung oder Verhinderung von Betrug oder anderen rechtswidrigen Aktivitäten verhindern oder beeinträchtigen, (ii) die legitimen Interessen anderer Mitglieder oder Dritter beeinträchtigen oder (iii) gegen geltende Gesetze verstoßen.

Wenn wir eine dieser Maßnahmen ergreifen, wird Airbnb Sie, soweit erforderlich, gemäß seinen gesetzlichen Verpflichtungen mit einer Begründung über die Maßnahme informieren.

13.4 Rechtliche Anforderungen. Airbnb kann alle Maßnahmen ergreifen, die angemessen und erforderlich sind, um geltendes Recht oder die Anordnung oder Aufforderung eines Gerichts, einer Strafverfolgungsbehörde oder einer anderen Verwaltungsbehörde oder Regierungsbehörde einzuhalten, einschließlich der oben in Ziffer 13.3 beschriebenen Maßnahmen.

13.5 Auswirkungen der Kündigung. Wenn Sie Gastgeber:in sind und Ihr Airbnb-Konto kündigen, werden alle bestätigten Buchungen automatisch storniert und Ihre Gäste erhalten eine vollständige Rückerstattung. Wenn Sie Ihr Konto bei Airbnb als Gast kündigen, werden alle bestätigten Buchungen automatisch storniert. Jegliche Rückerstattung hängt von den im jeweiligen Inserat angegebenen Stornierungsbedingungen ab. Nach einer Kündigung dieses Vertrags haben Sie keinen Anspruch auf Wiederherstellung Ihres Kontos oder Ihrer Inhalte. Wenn Ihre Nutzung der Airbnb-Plattform eingeschränkt, Ihr Airbnb-Konto gesperrt oder dieser Vertrag von uns gekündigt wurde, dürfen Sie kein neues Airbnb-Konto registrieren oder über ein Konto eines anderen Mitglieds auf die Airbnb-Plattform zugreifen oder diese nutzen.

14. Bearbeitung von Beschwerden.

14.1 Wenn Sie Mitglied sind und Ihren Wohnsitz oder Ihre Niederlassung im EWR haben und Airbnb eine der Maßnahmen gemäß Ziffer 13.3 mit der Begründung ergreift, dass von Ihnen bereitgestellte Inhalte rechtswidrig oder mit diesen Nutzungsbedingungen unvereinbar sind, können Sie über unser internes System zur Bearbeitung von Beschwerden eine Beschwerde gegen eine solche Maßnahme einreichen. Mehr darüber, wie Sie eine Beschwerde einreichen, erfahren Sie in unserem Hilfe-Center.

14.2 Das Airbnb-System zur Bearbeitung von Beschwerden steht auch Mitgliedern und Dritten mit Wohnsitz oder Niederlassung im EWR zur Verfügung, die eine Inhaltsmeldung gemäß Ziffer 12.3 dieser Nutzungsbedingungen eingereicht haben, wenn diese Meldung von Airbnb ganz oder teilweise abgelehnt wurde.

14.3 Eine Beschwerde kann über unser System zur Bearbeitung von Beschwerden für einen Zeitraum von sechs (6) Monaten eingereicht werden, beginnend im Falle von Ziffer 14.1 mit dem Tag, an dem ein Mitglied über die getroffene Maßnahme informiert wird, und im Falle von Ziffer 14.2 mit dem Tag, an dem der/die Hinweisgeber:in über die Ablehnung seiner/ihrer Inhaltsmeldung informiert wird.

14.4 Airbnb ist berechtigt, die Bearbeitung von Beschwerden von Mitgliedern und Hinweisgeber:innen für einen angemessenen Zeitraum auszusetzen, wenn das betreffende Mitglied oder der/die betreffende Hinweisgeber:in häufig Beschwerden einreicht, die offensichtlich unbegründet sind. Gegebenenfalls wird Airbnb vor einer solchen Aussetzung eine Warnung aussprechen. Bei der Entscheidung über eine Aussetzung berücksichtigt Airbnb alle relevanten Tatsachen und Umstände, die aus den Airbnb vorliegenden Informationen hervorgehen, einschließlich (i) des Umfangs, der Schwere und der Häufigkeit der unbegründeten Beschwerden; (ii) des Verhältnisses der unbegründeten Beschwerden zu allen Beschwerden; und (iii) der vom Mitglied oder vom Hinweisgeber bzw. von der Hinweisgeberin verfolgten Absichten, soweit Airbnb dies feststellen kann.

14.5 Mitglieder, die von Maßnahmen gemäß Ziffer 14.1 betroffen sind, und Hinweisgeber:innen, die Inhaltsmeldungen eingereicht haben, die von Airbnb abgelehnt wurden, sind berechtigt, eine zertifizierte außergerichtliche Streitbeilegungsstelle gemäß Artikel 21 der Verordnung (EU) 2022/2065 auszuwählen, um Streitigkeiten im Zusammenhang mit diesen Maßnahmen beizulegen, einschließlich Beschwerden, die nicht durch unser System zur Bearbeitung von Beschwerden beigelegt wurden. Beide Parteien bemühen sich nach Treu und Glauben um die Beilegung der Streitigkeit mit der ausgewählten Streitbeilegungsstelle. Airbnb behält sich das Recht vor, die Einschaltung der Streitbeilegungsstelle abzulehnen, wenn ein Streit über denselben Inhalt und die Gründe für die angebliche Rechtswidrigkeit des Inhalts oder seine angebliche Unvereinbarkeit mit diesen Nutzungsbedingungen bereits vor einem zuständigen Gericht oder einer anderen zuständigen außergerichtlichen Streitbeilegungsstelle geklärt wurde oder bereits Gegenstand eines laufenden Verfahrens ist.

14.6 Bei allen anderen Anfragen und Beschwerden, die nicht dem Airbnb-System zur Bearbeitung von Beschwerden unterliegen, können sich Mitglieder an den Airbnb-Support wenden.

15. Änderung dieser Nutzungsbedingungen.

Wenn wir Änderungen an diesen Nutzungsbedingungen vorschlagen, werden wir die überarbeiteten Nutzungsbedingungen auf der Airbnb-Plattform veröffentlichen und das Datum unter „Letzte Aktualisierung“ am Anfang dieser Nutzungsbedingungen anpassen. Wir werden Sie mindestens dreißig (30) Tage vor dem Zeitpunkt des Inkrafttretens per E-Mail, über die Airbnb-Plattform, über unseren Nachrichtenservice oder über eine andere von uns zur Verfügung gestellte und von Ihnen ausgewählte Kontaktmethode über die vorgeschlagenen Änderungen informieren. Wenn die vorgeschlagenen Änderungen an diesen Nutzungsbedingungen wesentlich sind, werden wir Sie dazu auffordern, den überarbeiteten Nutzungsbedingungen ausdrücklich zuzustimmen. In einer solchen Mitteilung informieren wir Sie auch über Ihr Recht, die geplanten Änderungen abzulehnen, sowie über den Zeitrahmen, in dem Sie dies tun können, und über Ihr Recht, die Vereinbarung jederzeit vor dem Datum des Inkrafttretens der geplanten Änderungen zu kündigen, wie in diesen Nutzungsbedingungen vorgesehen. Im Falle von (i) unwesentlichen Änderungen dieser Nutzungsbedingungen, die wesentliche Bestimmungen, insbesondere Bestimmungen, die die Art und den Umfang der von Airbnb erbrachten Leistungen festlegen, nicht berühren, oder (ii) Änderungen, die durch ein Gesetz, eine rechtskräftige Gerichtsentscheidung oder eine verbindliche Anordnung einer zuständigen Behörde vorgeschrieben sind, gilt Ihre fortgesetzte Nutzung der Airbnb-Plattform nach dem Datum des Inkrafttretens der geplanten Änderungen als Zustimmung zu den überarbeiteten Nutzungsbedingungen.

16. Beilegung von Beschwerden und Schadenersatzforderungen zwischen Mitgliedern.

16.1 Wenn ein Mitglied nachweisen kann, dass Sie, Ihr Gast / Ihre Gäste oder Ihr(e) Haustier(e):

(i) die Unterkunft oder persönliches Eigentum des beschwerdeführenden Mitglieds oder des Eigentümers bzw. der Eigentümerin der Unterkunft (wenn der/die Eigentümer:in der Unterkunft nicht gleichzeitig der/die Gastgeber:in ist) oder Immobilien oder persönliches Eigentum, für die/das das beschwerdeführende Mitglied verantwortlich ist oder an denen/dem es ein wirtschaftliches Interesse hat, schuldhaft beschädigt haben; oder

(ii) den Verlust von Buchungseinnahmen bei über die Airbnb-Plattform vorgenommenen Buchungen oder andere Folgeschäden schuldhaft verursacht haben, die direkt aus den unter (i) oben verursachten Schäden resultieren; oder

(iii) dem beschwerdeführenden Mitglied aus anderen Gründen Reinigungskosten schuldhaft verursacht haben, die über die vom Mitglied festgelegte Reinigungsgebühr hinausgehen (wobei jeder der Punkte (i), (ii) und (iii) einer „Schadenersatzforderung“ entspricht),

kann das beschwerdeführende Mitglied Airbnb darüber informieren und/oder über das Mediations-Center eine Ausgleichszahlung verlangen. Sie werden über die Schadenersatzforderung informiert und erhalten die Gelegenheit, darauf zu reagieren. Wenn Sie der Zahlung zustimmen, ermächtigen Sie Airbnb über Airbnb Payments, den Betrag der Schadenersatzforderung von Ihnen einzuziehen.

16.2
 Wenn der/die Gastgeber:in und der Gast sich nicht einigen können, oder wenn ein Gast einer Schadenersatzforderung nicht nachkommt, kann der/die Gastgeber:in Airbnb im Rahmen der Bedingungen des Programms „Schutz für Gastgeber:innen bei Sachschäden“ über das Mediations-Center benachrichtigen und eine Ausgleichszahlung verlangen. Airbnb prüft die Schadenersatzforderung und fordert den/die Gastgeber:in auf, alle erforderlichen Nachweise (z. B. geeignete Dokumente, Fotos, Rechnungen, Gutachten Dritter usw.) vorzulegen, die die Schadenersatzforderung und deren Höhe belegen. Der Gast erhält die Möglichkeit, darauf zu antworten und alle relevanten Gegenbeweise vorzulegen. Wenn Airbnb auf Grundlage der Bedingungen des Programms „Schutz für Gastgeber:innen bei Sachschäden“ und unter Berücksichtigung der vorgelegten Beweise und der geltenden gesetzlichen Vorschriften zur Beweislast feststellt, dass der Schadenersatzbetrag gerechtfertigt ist und dass der Gast für den Schaden verantwortlich ist, zahlt Airbnb über Airbnb Payments den Schadenersatzbetrag an den/die Gastgeber:in aus. Wenn Airbnb den Schadenersatzanspruch an den/die Gastgeber:in auszahlt, kann Airbnb den vollen Betrag des Schadenersatzanspruchs vom Gast zurückfordern, auch indem wir versuchen, die Zahlungsart des Gastes bis zu einem Höchstbetrag von 500 US-Dollar zu belasten. Airbnb behält sich zudem vor, Ansprüche zur Wiedererlangung von Schadenersatzbeträgen, einschließlich der Beträge, die den Höchstbetrag für die Belastung der Zahlungsart des Gastes übersteigen, gegen einen Gast geltend zu machen, indem wir alle Rechtsmittel nutzen, die uns nach geltendem Recht zur Verfügung stehen, einschließlich der Weiterleitung der Angelegenheit an ein Inkassobüro und/oder der Verfolgung verfügbarer Klagegründe und/oder Ansprüche gegen einen Gast. Mitglieder können der Entscheidung von Airbnb widersprechen, indem sie sich an den Airbnb-Support wenden. Im Verhältnis zwischen Mitgliedern und Airbnb liegt die Beweislast für den Schadenersatzanspruch und die Höhe des Schadens stets bei Airbnb.

16.3 Sie erklären sich bereit, in gutem Glauben mit Airbnb zu kooperieren, alle von Airbnb angeforderten Informationen zur Verfügung zu stellen, Dokumente auszuführen und weitere angemessene Maßnahmen im Zusammenhang mit Schadenmeldungen, Beschwerden von Mitgliedern, Ansprüchen aus Versicherungspolicen oder anderen Ansprüchen im Zusammenhang mit Ihrer Bereitstellung oder Nutzung der Gastgeber:innen-Services zu ergreifen.

16.4 Sämtliche Entscheidungen, die Airbnb in Bezug auf einen Schadenersatzanspruch trifft, berühren nicht Ihre vertraglichen und gesetzlichen Rechte. Ihr Recht, den ordentlichen Rechtsweg zu beschreiten, bleibt unberührt.

17. Die Rolle von Airbnb.

Wir bieten Ihnen die Berechtigung zur Nutzung einer Plattform, auf der Mitglieder Gastgeber:innen-Services veröffentlichen, anbieten, suchen und buchen können. Wenn Mitglieder eine Buchung vornehmen bzw. bestätigen, schließen sie direkt miteinander einen Vertrag. Airbnb ist und wird keine Vertragspartei oder sonstiger Beteiligter an dem Vertragsverhältnis zwischen Mitgliedern. Airbnb handelt nicht als Vertreter für Mitglieder, außer wenn Airbnb Payments wie in den Zahlungsbedingungen angegeben als Zahlungsabwickler fungiert. Auch wenn wir intensiv daran arbeiten, unseren Mitgliedern großartige Erfahrungen bei der Nutzung der Airbnb-Plattform zu ermöglichen, können wir das Verhalten oder die Leistungsfähigkeit von Gästen und Gastgeber:innen nicht kontrollieren und garantieren nicht (i) die Existenz, Qualität, Sicherheit, Eignung oder Rechtmäßigkeit von Inseraten oder Gastgeber:innen-Services oder (ii) die Wahrheit oder Genauigkeit der Angaben von Inseratsbeschreibungen, Bewertungen oder anderen Inhalten, die von Mitgliedern bereitgestellt werden. Sie erkennen an, dass Airbnb das Recht hat, Inhalte zu prüfen, zu entfernen, zu bearbeiten oder den Zugriff darauf zu sperren, um: (i) die Airbnb-Plattform zu betreiben, zu sichern und zu verbessern (insbesondere zu Zwecken der Betrugsprävention, Risikobewertung, Durchführung von Untersuchungen und Kund:innenbetreuung); (ii) sicherzustellen, dass Mitglieder diese Nutzungsbedingungen einhalten; (iii) geltendes Recht oder die Anordnung oder Anforderung eines Gerichts, einer Strafverfolgungsbehörde oder einer anderen Verwaltungsbehörde oder Regierungsbehörde einzuhalten; (iv) auf Inhalte von Mitgliedern zu reagieren, bei denen wir feststellen, dass sie schädlich oder anstößig sind; (v) Maßnahmen zu ergreifen, die in diesen Nutzungsbedingungen festgelegt sind; und (vi) Qualitäts- oder Eignungskriterien aufrechtzuerhalten und durchzusetzen, einschließlich der Entfernung von Inseraten, die nicht den Qualitäts- und Eignungskriterien entsprechen. Wenn wir Inhalte entfernen oder den Zugriff darauf sperren, benachrichtigen wir das betreffende Mitglied und geben die Gründe für eine solche Maßnahme an, es sei denn, eine solche Benachrichtigung würde (i) die Aufdeckung oder Verhinderung von Betrug oder anderen rechtswidrigen Aktivitäten unterbinden oder beeinträchtigen, (ii) die legitimen Interessen anderer Mitglieder oder Dritter beeinträchtigen oder (iii) gegen geltende Gesetze verstoßen.

18. Airbnb-Konten.

Sie müssen ein Airbnb-Konto registrieren, um auf bestimmte Funktionen der Airbnb-Plattform zugreifen und diese nutzen zu können. Die Registrierung ist nur juristischen Personen, Personengesellschaften und natürlichen Personen im Alter von mindestens 18 Jahren gestattet. Wenn Sie gemäß Ziffer 26 als gewerbliche:r Vermieter:in tätig sind, gelten zusätzliche Bedingungen. Sie versichern, dass Sie keine natürliche oder juristische Person sind, die nach den Gesetzen der USA, Ihres Wohnortes oder einer anderen anwendbaren Rechtsordnung von der Nutzung der Airbnb-Plattform ausgeschlossen ist. Sie müssen bei der Registrierung zutreffende, aktuelle und vollständige Angaben machen und die Informationen in Ihrem Airbnb-Konto stets auf dem neuesten Stand halten. Sie dürfen Ihr Airbnb-Konto nicht auf andere Personen übertragen. Sie sind dafür verantwortlich, die Vertraulichkeit und Sicherheit Ihrer Anmeldedaten zu wahren, und dürfen diese Dritten gegenüber nicht offenlegen. Sie müssen Airbnb unverzüglich benachrichtigen, wenn Sie den Verdacht haben, dass Ihre Anmeldedaten verloren gegangen sind, gestohlen wurden oder Ihr Airbnb-Konto anderweitig kompromittiert wurde. Sie sind für alle Aktivitäten, die über Ihr Airbnb-Konto vorgenommen werden, verantwortlich, es sei denn, diese Aktivitäten wurden von Ihnen weder genehmigt noch auf andere Weise fahrlässig herbeigeführt (z. B. indem Sie eine unbefugte Nutzung oder einen Verlust Ihrer Anmeldedaten nicht melden). Wenn und soweit dies das jeweils geltende Recht zulässt, sind wir berechtigt, aber nicht verpflichtet, (i) Sie um ein Ausweisdokument oder andere Informationen zu bitten, (ii) Überprüfungen durchzuführen, um Ihre Identität oder Ihren Hintergrund zu verifizieren, (iii) Sie mithilfe externer Datenbanken oder sonstiger Quellen zu überprüfen und Berichte von Dienstleistern anzufordern und (iv) Berichte aus öffentlichen Aufzeichnungen über strafrechtliche Verurteilungen oder Registrierungen als Sexualstraftäter oder deren lokale Entsprechungen einzuholen.

19. Hinweise.

Wir garantieren nicht die Existenz, das Verhalten, die Leistungsfähigkeit, Sicherheit, Qualität, Rechtmäßigkeit oder Eignung von Gästen, Gastgeber:innen, Gastgeber:innen-Services, Inseraten oder Dritten und garantieren nicht, dass etwaige Verifizierungen, Identitäts- oder Hintergrundüberprüfungen von Mitgliedern (falls zutreffend) vergangenes Fehlverhalten aufdecken oder zukünftiges Fehlverhalten verhindern. Jeder Hinweis darauf, dass ein Mitglied „verifiziert“ wurde (oder eine ähnliche Formulierung), zeigt nur an, dass das Mitglied oder Airbnb ein entsprechendes Verifizierungs- oder Identifizierungsverfahren durchgeführt hat. Wir sind nicht verantwortlich für Ausfälle oder Störungen der Internet- und Telekommunikationsinfrastruktur, die außerhalb unserer Kontrolle liegen und zu Unterbrechungen der Verfügbarkeit der Airbnb-Plattform führen können. Airbnb kann unter Berücksichtigung der berechtigten Interessen der Mitglieder (z. B. durch vorherige Ankündigung) die Verfügbarkeit der Airbnb-Plattform oder bestimmter Funktionen derselben vorübergehend einschränken, wenn dies im Hinblick auf Kapazitätsengpässe, die Sicherheit oder die Integrität unserer Server oder zur Durchführung von Wartungsmaßnahmen, die die ordnungsgemäße oder verbesserte Funktion der Airbnb-Plattform gewährleisten, erforderlich ist.

20. Haftung.

20.1 Airbnb haftet nach den gesetzlichen Vorschriften unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer fahrlässigen oder vorsätzlichen Pflichtverletzung von Airbnb oder seiner gesetzlichen Vertreter:innen oder Erfüllungsgehilf:innen beruhen. Gleiches gilt für abgegebene Garantien oder jede andere verschuldensunabhängige Haftung.

20.2 Airbnb haftet auch unbeschränkt für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung von Airbnb oder seiner gesetzlichen Vertreter:innen oder Erfüllungsgehilf:innen beruhen.

20.3 Airbnb haftet nicht für Schäden, die aus einer Pflichtverletzung aufgrund einfacher Fahrlässigkeit entstehen.

20.4 Ziffer 20.3 gilt nicht für Schäden, die sich aus der Verletzung wesentlicher Vertragspflichten ergeben und auf einfacher Fahrlässigkeit beruhen. Für solche Schäden durch Airbnb, seine gesetzlichen Vertreter:innen oder andere Erfüllungsgehilf:innen ist die Haftung von Airbnb auf den typischerweise eintretenden vorhersehbaren Schaden begrenzt. Wesentliche Vertragspflichten sind solche Pflichten von Airbnb, auf deren Erfüllung Sie zur ordnungsgemäßen Durchführung des Vertrages regelmäßig vertrauen und vertrauen dürfen.

20.5 Soweit die Haftung von Airbnb ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung der gesetzlichen Vertreter:innen, Angestellten und sonstigen Erfüllungsgehilf:innen.

21. Freistellung.

Sie erklären sich damit einverstanden, Airbnb (einschließlich Airbnb Payments, andere verbundene Unternehmen und deren Mitarbeiter:innen) im größtmöglichen durch das anwendbare Recht erlaubten Umfang freizustellen, zu verteidigen (nach Ermessen von Airbnb), zu entschädigen und schadlos zu halten von und gegen jegliche Ansprüche, Verbindlichkeiten, Schäden, Verluste und Ausgaben, einschließlich, ohne Einschränkung, angemessener Rechts- und Buchhaltungskosten, die sich aus oder in Verbindung mit Folgendem ergeben: (i) Ihrem Verstoß gegen diese Nutzungsbedingungen (einschließlich aller zusätzlichen oder ergänzenden Bedingungen, die für ein Produkt oder eine Funktion gelten) oder unsere zusätzlichen vertraglichen Bedingungen, Richtlinien oder Standards; (ii) Ihrer unsachgemäßen Nutzung der Airbnb-Plattform; (iii) Ihrer Interaktion mit einem Mitglied, Ihrem Aufenthalt in einer Unterkunft, Ihrer Teilnahme an einer Entdeckung oder Ihrer Inanspruchnahme anderer Gastgeber:innen-Services, einschließlich und ohne Einschränkung aller Verletzungen, Verluste oder Schäden (ob ausgleichend, direkt, zufällig, als Folge oder anderweitig) jeglicher Art, die in Verbindung mit oder als Ergebnis einer solchen Interaktion, eines solchen Aufenthalts, einer solchen Teilnahme oder Inanspruchnahme entstehen; (iv) Ihrem Versäumnis oder unserem Versäumnis auf Ihre Anweisung hin, Steuern korrekt zu melden, einzuziehen oder abzuführen; oder (v) Ihrem Verstoß gegen Gesetze, Vorschriften oder Rechte Dritter wie geistige Eigentumsrechte oder Datenschutzrechte. Diese Freistellungsverpflichtung gilt nur, wenn und soweit die Ansprüche, Verbindlichkeiten, Schäden, Verluste und Aufwendungen durch Ihre schuldhafte Verletzung einer vertraglichen Verpflichtung verursacht wurden.

22. Vertragspartner.

Auf der Grundlage Ihres Wohn- oder Geschäftssitzes und Ihren Aktivitäten auf der Airbnb-Plattform gibt Anhang 1 unten das Airbnb-Unternehmen an, mit dem Sie einen Vertrag abschließen. Wenn Ihnen über die Airbnb-Plattform ein anderes als das in Anhang 1 aufgeführte Airbnb-Unternehmen als für ein Produkt, eine Funktion oder eine Transaktion verantwortlich angezeigt wird, ist das so ermittelte Airbnb-Unternehmen Ihr:e Vertragspartner:in in Bezug auf dieses Produkt, diese Funktion oder Transaktion. Wenn Sie Ihren Wohn- oder Geschäftssitz in ein Land außerhalb des EWR, der Schweiz oder des Vereinigten Königreichs verlegen, richten sich Ihr:e Vertragspartner:in und die gültige Version der Nutzungsbedingungen ab dem Datum, an dem sich Ihr Wohn- oder Geschäftssitz ändert, nach Ihrem neuen Wohn- oder Geschäftssitz.

23. Rechtswahl und Gerichtsstand.

Diese Nutzungsbedingungen unterliegen irischem Recht. Soweit Sie Verbraucher:in sind und zwingende gesetzliche Verbraucherschutzvorschriften Ihres Wohnsitzlandes für Sie vorteilhaftere Regelungen enthalten, gelten diese Regelungen unabhängig von der Wahl irischen Rechts. Als Verbraucher:in können Sie Ansprüche im Zusammenhang mit diesen Nutzungsbedingungen nur vor dem zuständigen Gericht an Ihrem Wohnsitz oder vor dem zuständigen Gericht am Unternehmenssitz von Airbnb in Irland geltend machen. Wenn Airbnb seine Rechte gegen Sie als Verbraucher:in durchsetzen möchte, können wir das nur vor den zuständigen Gerichten an Ihrem Wohnsitz tun. Wenn Sie als Unternehmen handeln, erklären Sie sich damit einverstanden, sich der ausschließlichen Zuständigkeit der irischen Gerichte zu unterwerfen.

24. Sonstiges.

24.1 Andere durch Verweis einbezogene Bedingungen. Unsere Bedingungen des Programms „Schutz für Gastgeber:innen bei Sachschäden“, unsere Bedingungen des Versicherungsprogramms für Gastgeber:innen in Japan, unsere Richtlinie für Umbuchungen und Rückerstattungen, unsere Richtlinie für Rückerstattungen an Gäste von Entdeckungen, unsere Richtlinien für angemessene Inhalte, unsere Antidiskriminierungs-Richtlinie, unsere Richtlinien für besondere Umstände, unsere zusätzlichen rechtlichen Bestimmungen sowie unsere sonstigen Richtlinien, Standards und weitere ergänzende Richtlinien und Bedingungen, auf die in diesen Nutzungsbedingungen verwiesen wird, gelten für Ihre Nutzung der Airbnb-Plattform, sind durch Verweis einbezogen und Bestandteil Ihres Vertrags mit Airbnb.

24.2 Auslegung dieser Nutzungsbedingungen. Sofern sie nicht durch zusätzliche Bedingungen, Regelungen, Richtlinien, Standards und produktinterne Offenlegungen ergänzt werden können, stellen diese Nutzungsbedingungen die gesamte Vereinbarung zwischen Airbnb und Ihnen in Bezug auf Ihren Zugriff auf die bzw. Ihre Nutzung der Airbnb-Plattform dar und ersetzen sämtliche vorherigen mündlichen oder schriftlichen Vereinbarungen zwischen Airbnb und Ihnen. Diese Nutzungsbedingungen zielen nicht darauf ab, Rechte oder Rechtsbehelfe auf andere Personen außer Ihnen und Airbnb zu übertragen. Sollte eine Bestimmung dieser Nutzungsbedingungen ungültig oder nicht durchsetzbar sein, wird diese Bestimmung gestrichen, was keinen Einfluss auf die Gültigkeit und Durchsetzbarkeit der verbleibenden Bestimmungen hat. An die Stelle von nicht einbezogenen oder unwirksamen Bestimmungen dieser Nutzungsbedingungen tritt das Gesetzesrecht.

24.3 Kein Verzicht. Die Nicht-Durchsetzung eines Rechts oder einer Bestimmung dieser Nutzungsbedingungen durch Airbnb stellt keinen Verzicht auf dieses Recht oder diese Bestimmung dar, sofern wir dazu nicht schriftlich unsere Zustimmung erteilen. Sofern nicht ausdrücklich in diesen Nutzungsbedingungen festgelegt, bleibt die Ausübung eines der Rechtsmittel durch eine der Parteien gemäß diesen Nutzungsbedingungen unbeschadet ihrer anderen Rechtsmittel gemäß diesen Nutzungsbedingungen oder anderweitig gesetzlich zulässig.

24.4 Übertragung. Sie sind nicht berechtigt, diesen Vertrag oder Ihre Rechte und Pflichten im Rahmen dieses Vertrags ohne die vorherige schriftliche Zustimmung von Airbnb abzutreten, zu übertragen oder zu delegieren. Airbnb kann diesen Vertrag und alle Rechte und Pflichten, die sich aus diesem ergeben, uneingeschränkt nach alleinigem Ermessen und unter Einhaltung einer 30-tägigen Mitteilungsfrist abtreten, übertragen oder delegieren. Ihr Recht, diesen Vertrag gemäß Ziffer 13.2 jederzeit zu kündigen, bleibt unberührt.

24.5 Benachrichtigungen. Sofern nichts anderes festgelegt wird, erfolgen alle im Rahmen dieses Vertrags erlaubten oder erforderlichen Mitteilungen und sonstigen Nachrichten an Mitglieder elektronisch und werden durch Airbnb per E-Mail, über die Airbnb-Plattform oder Messaging-Dienste (wie SMS und WeChat) oder über weitere Kontaktmethoden, die wir Ihnen anbieten, übermittelt. Wenn sich eine Benachrichtigung auf eine Buchung oder ein Inserat in Japan bezieht, stimmen Sie zu, dass solche Benachrichtigungen auf elektronischem Wege anstelle einer schriftlichen Erklärung die Verpflichtungen von Airbnb gemäß Artikel 59 Absatz 1 des japanischen Housing Accommodation Business Act erfüllen.

24.6 Dienstleistungen Dritter. Die Airbnb-Plattform kann Links zu Websites, Apps, Diensten oder Ressourcen Dritter enthalten („Dienstleistungen Dritter“), die anderen Bedingungen und Datenschutzpraktiken unterliegen. Airbnb ist nicht verantwortlich für jegliche Art von Dienstleistungen Dritter und Links zu solchen Dienstleistungen Dritter stellen keine Empfehlung durch Airbnb dar.

24.7 Bedingungen von Google. Einige Übersetzungen auf der Airbnb-Plattform werden von Google bereitgestellt. Google schließt alle ausdrücklichen oder stillschweigenden Gewährleistungen im Zusammenhang mit den Übersetzungen aus, einschließlich aller Gewährleistungen der Genauigkeit, Zuverlässigkeit und aller stillschweigenden Gewährleistungen der Marktgängigkeit, der Eignung für einen bestimmten Zweck und der Nichtverletzung von Rechten Dritter. Manche Bereiche der Airbnb-Plattform nutzen Google Maps/Earth-Kartendienste einschließlich Google-Maps-Schnittstellen. Ihre Nutzung von Google Maps/Earth unterliegt den zusätzlichen Nutzungsbedingungen von Google Maps/Google Earth.

24.8 Bedingungen von Apple. Wenn Sie vom Apple App Store aus auf unsere App zugreifen oder sie von dort herunterladen, stimmen Sie dem Endnutzer:innen-Lizenzvertrag für lizenzierte Anwendungen von Apple zu.

24.9 Inhalte der Airbnb-Plattform. Inhalte, die über die Airbnb-Plattform zur Verfügung gestellt werden, sind möglicherweise durch Urheber-, Marken- und weitere Gesetze der USA und anderer Länder geschützt. Alle geistigen Eigentumsrechte an diesen Inhalten sind das ausschließliche Eigentum von Airbnb und/oder seinen Lizenzgebern. Sie dürfen keine Hinweise auf Urheberrechts-, Marken-, Dienstleistungsmarken- oder andere Eigentumsrechte entfernen, ändern oder unkenntlich machen. Sie dürfen sämtliche Inhalte, auf die Sie über die Airbnb-Plattform zugreifen, nicht nutzen, kopieren, anpassen, ändern, daraus abgeleitete Werke erstellen, vertreiben, lizenzieren, verkaufen, übertragen, öffentlich wiedergeben, öffentlich verbreiten, übermitteln, senden oder anderweitig verwerten, es sei denn, Sie sind der rechtmäßige Inhaber dieser Inhalte oder insofern dies in diesen Nutzungsbedingungen ausdrücklich gestattet wird. Airbnb gewährt Ihnen, vorbehaltlich der Einhaltung dieser Nutzungsbedingungen, eine beschränkte, einfache, nicht unterlizenzierbare, widerrufbare und nicht übertragbare Lizenz für (i) das Herunterladen und die Nutzung der App auf Ihren persönlichen Geräten; und (ii) den Zugriff auf und die Ansicht der Inhalte, die Ihnen auf der oder über die Airbnb-Plattform zur Verfügung gestellt werden, ausschließlich zur persönlichen und nicht gewerblichen Nutzung.

24.10 Airbnb.org. Airbnb.org ist eine gemeinnützige Gesellschaft, die gemäß Abschnitt 501(c)(3) des US-Internal Revenue Code von der Einkommensteuer befreit und als öffentliche Wohltätigkeitsorganisation tätig ist. Airbnb.org befindet sich nicht im Besitz oder unter der Kontrolle von Airbnb. Airbnb.org verwaltet eine Reihe gemeinnütziger Programme, die unserer Gastgeber:innen- und Gäste-Community sowie der Öffentlichkeit zugute kommen.

24.11 Höhere Gewalt. Airbnb haftet nicht für Verspätungen oder Nichterfüllung, die auf außergewöhnliche und unvorhersehbare Umstände zurückzuführen sind, die außerhalb der Kontrolle von Airbnb liegen und deren Folgen trotz aller gegenteiligen Bemühungen unvermeidbar gewesen wären, einschließlich, aber nicht beschränkt auf höhere Gewalt, Krieg, Terrorismus, Unruhen, Embargos, Handlungen von Zivil- oder Militärbehörden, Feuer, Überschwemmungen, Unfälle, Pandemien, Epidemien oder Krankheiten, Streiks oder Engpässe bei Transportmitteln, Treibstoff, Energie, Arbeitskräften oder Materialien.

24.12 E-Mails und SMS. Sie erhalten administrative Mitteilungen von uns über die E-Mail-Adresse oder andere Kontaktdaten, die Sie für Ihr Airbnb-Konto angeben. Die Anmeldung in zusätzlichen E-Mail-Abonnementprogrammen hat keinen Einfluss auf die Häufigkeit dieser administrativen E-Mails, auch wenn Sie erwarten sollten, zusätzliche E-Mails speziell für das/die Programm(e) zu erhalten, für das/die Sie sich angemeldet haben. Gegebenenfalls erhalten Sie auch Werbe-E-Mails von uns, sofern Sie dem zugestimmt haben. Wir erheben keine Gebühr für diese Werbe-E-Mails, es können jedoch Gebühren von Dritten für Datenvolumen anfallen. Sie können über die Benachrichtigungseinstellungen in Ihrem Airbnb-Konto steuern, ob Sie Werbe-E-Mails erhalten. 25. Streitbeilegung und Schiedsvereinbarung in den USA.

BITTE LESEN SIE DIE FOLGENDEN ABSÄTZE SORGFÄLTIG DURCH, DA DIESE VORSEHEN, DASS SIE UND AIRBNB SICH DAMIT EINVERSTANDEN ERKLÄREN, ALLE STREITIGKEITEN ZWISCHEN IHNEN DURCH EIN VERBINDLICHES SCHIEDSGERICHT ZU LÖSEN, UND EINEN VERZICHT AUF SAMMELKLAGEN UND AUF EIN SCHWURGERICHTSVERFAHREN ENTHALTEN. Diese Schiedsvereinbarung ersetzt alle früheren Versionen.

25.1 Anwendung. Diese Schiedsvereinbarung gilt nur für Sie, wenn sich Ihr Wohn- oder Geschäftssitz in den USA befindet. Wenn sich Ihr Wohn- oder Geschäftssitz nicht in den USA befindet und Sie dennoch versuchen, einen Rechtsanspruch gegen Airbnb in den USA geltend zu machen, gilt diese Schiedsvereinbarung für die Bestimmung des Schwellenwerts, ob diese Ziffer 25 für Sie gilt, und für alle anderen Schwellenwertbestimmungen, einschließlich Wohnsitz, Schiedsfähigkeit, Gerichtsstand und geltendem Recht.

25.2 Übersicht über das Streitbeilegungsverfahren. Airbnb ist daran gelegen, an einem verbraucher:innenfreundlichen Streitbeilegungsverfahren mitzuwirken. Zu diesem Zweck sehen diese Bedingungen einen zweiteiligen Prozess für Einzelpersonen vor, auf die diese Ziffer 25 zutrifft: (1) eine informelle Verhandlung direkt mit dem Team des Airbnb-Supports (wie in Ziffer 25.3 unten beschrieben) und, falls erforderlich, (2) ein verbindliches Schiedsverfahren gemäß den Bedingungen dieser Schiedsvereinbarung. Sie und Airbnb behalten sich jeweils das Recht vor, als Alternative zum Schiedsverfahren vor einem Gericht, das für geringfügige Forderungen zuständig ist, Klage zu erheben.

25.3 Obligatorische Streitbeilegung und Benachrichtigung vor dem Schiedsverfahren. Sie und Airbnb verpflichten sich, der anderen Partei mindestens 30 Tage vor der Einleitung eines Schiedsverfahrens eine individuelle schriftliche Mitteilung über den Streitfall zukommen zu lassen („Vorabinformation zum Streitfall“) und nach Treu und Glauben zu versuchen, eine gütliche Einigung über den individuellen Anspruch zu erzielen. Sie müssen Ihre Vorabinformation zum Streitfall per Post an Airbnb senden und an den zuständigen Zustellungsempfänger adressieren: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833, USA. Airbnb sendet diese Vorabinformation zum Streitfall an die E-Mail-Adresse, die mit Ihrem Airbnb-Konto verknüpft ist. Die Vorabinformation zum Streitfall muss Folgendes enthalten: das Datum, Ihren Namen, Ihre Postanschrift, Ihren Namen auf der Airbnb-Plattform, die E-Mail-Adresse, mit der Sie Ihr Airbnb-Konto erstellt haben, Ihre Unterschrift, eine kurze Beschreibung der Streitigkeit und den angestrebten Rechtsbehelf. Wenn die Parteien die Streitigkeit nicht innerhalb der Frist von 30 Tagen beilegen können, kann eine der Parteien erst dann ein Schiedsverfahren einleiten, indem sie einen schriftlichen Antrag auf ein Schiedsverfahren bei der gemäß Ziffer 24.6 benannten Schlichtungsstelle einreicht. Das Erfordernis der Vorabinformation zum Streitfall ist eine Voraussetzung für jedes Schiedsverfahren, und eine Kopie der Vorabinformation zum Streitfall sowie der Nachweis, dass sie gemäß den Bestimmungen dieser Ziffer versandt wurde, müssen jedem Schlichtungsantrag beigefügt werden.

25.4 Schiedsgerichtsvereinbarung. Sie und Airbnb vereinbaren, dass jede Streitigkeit, jeder Anspruch oder jede Kontroverse, die aus oder in Verbindung mit diesen Bedingungen oder der Anwendbarkeit, Verletzung, Kündigung, Gültigkeit, Durchsetzung oder Auslegung derselben oder jeglicher Nutzung der Airbnb-Plattform, der Gastgeber:innen-Services oder jeglicher Inhalte (zusammen „Streitigkeiten“) entstehen, durch ein verbindliches individuelles Schiedsverfahren beigelegt wird (die „Schiedsvereinbarung“). Sofern Uneinigkeit darüber besteht, ob diese Schiedsvereinbarung durchgesetzt oder auf eine Streitigkeit angewendet werden kann, vereinbaren Sie und Airbnb, dass ein:e Schlichter:in über diese Frage entscheidet. Um Zweifel auszuschließen, erklären Sie und Airbnb sich damit einverstanden, dass alle Fragen bezüglich der Schiedsfähigkeit und des Zustandekommens, der Durchsetzbarkeit, der Gültigkeit, des Umfangs oder der Auslegung dieser Ziffer 25 oder eines Teils davon, einschließlich aller Streitigkeiten über die Einhaltung der Anforderung der Vorabinformation zum Streitfall und der Verantwortung einer Partei für die Zahlung von Schiedsgerichtsgebühren, ausschließlich von einem/einer Schlichter:in entschieden werden sollen.

25.5 Ausnahmen von der Schiedsvereinbarung. Sie und Airbnb stimmen jeweils zu, dass die folgenden Klagegründe und/oder Ansprüche auf Entschädigung Ausnahmen von der Schiedsvereinbarung sind und in einem Gerichtsverfahren vor einem zuständigen Gericht (wie in Ziffer 23 der Nutzungsbedingungen für außereuropäische Nutzer:innen definiert) geltend gemacht werden: (i) jegliche Ansprüche oder Klagegründe, die sich auf die tatsächliche oder drohende Verletzung, Veruntreuung oder Verletzung der Urheberrechte, Warenzeichen, Geschäftsgeheimnisse, Patente oder andere Rechte an geistigem Eigentum einer Partei beziehen; (ii) jegliche Ansprüche oder Klagegründe, die auf dringenden Umständen (z. B. unmittelbare Gefahr oder Begehung einer Straftat, Hacking, Cyber-Angriff) beruhen; (iii) ein Antrag auf Behebung eines öffentlichen Unterlassungsanspruchs; (iv) jegliche Ansprüche oder Klagegründe aufgrund eines schikanösen Rechtsstreits; oder (v) jegliche individuellen Forderungen aufgrund eines sexuellen Übergriffs oder sexueller Belästigung infolge Ihrer Nutzung der Airbnb-Plattform oder von Gastgeber:innen-Services. Sie und Airbnb erklären sich damit einverstanden, dass jeder Antrag auf Erlass eines öffentlichen Unterlassungsanspruchs nach dem Schiedsverfahren über alle schiedsrichterlichen Ansprüche, Rechtsbehelfe oder Klagegründe erfolgt und bis zum Abschluss des Schiedsverfahrens gemäß Abschnitt 3 des Federal Arbitration Act ausgesetzt wird.

25.6 Regeln des Schiedsgerichtforums und geltendes Recht. Diese Schiedsvereinbarung betrifft eine Transaktion im zwischenstaatlichen Handel. Die materielle und verfahrensrechtliche Auslegung und Durchsetzung dieser Schiedsvereinbarung unterliegt dem Federal Arbitration Act und nicht dem staatlichen Recht. Das Schiedsverfahren wird von ADR Services, Inc. („ADR“) (www.adrservices.com) in Übereinstimmung mit den Regeln 1, 6–7, 8–9, 11–12, 45, 54 und 56 der US-amerikanischen Zivilprozessordnung („Ausgewählte Bundesregeln“) (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) sowie den zu diesem Zeitpunkt geltenden ADR-Schiedsgerichtsregeln (die „ADR-Regeln“) verwaltet, es sei denn, die ausgewählten Bundesregeln oder ADR-Regeln werden durch diese Schiedsvereinbarung geändert oder stehen im Widerspruch zu ihr. Die ADR-Regeln finden Sie unter www.adrservices.com. Wenn ein Antrag auf ein Schiedsverfahren gemäß dieser Vereinbarung und den ADR-Regeln bei ADR Services eingereicht wird und ADR Services das Schiedsverfahren nicht durchführen kann oder will, wird das Schiedsverfahren von der American Arbitration Association („AAA“) in Übereinstimmung mit den ausgewählten Bundesregeln und den Verbraucher:innenschiedsregeln der AAA und/oder anderen AAA-Schiedsregeln durchgeführt, die von der AAA als anwendbar bestimmt wurden (die „AAA-Regeln“) und zu diesem Zeitpunkt in Kraft sind, mit Ausnahme der hier modifizierten Regeln. Die Schiedsgerichtsordnung der AAA finden Sie unter www.adr.org. Wenn die AAA das Schiedsverfahren nicht durchführen kann und will, müssen Sie und Airbnb sich beraten und ein alternatives Schiedsforum auswählen, und wenn wir uns nicht einigen können, können entweder Sie oder Airbnb ein Gericht um die Ernennung eines Schlichters / einer Schlichterin gemäß 9 U.S.C. § 5 bitten. In diesem Fall wird das Schiedsverfahren in Übereinstimmung mit den Regeln des benannten Schiedsgerichts durchgeführt, es sei denn, diese Regeln stehen im Widerspruch zu den Bestimmungen der vorliegenden Schiedsvereinbarung.

25.7 Änderung der Schiedsgerichtsordnung – Schiedsgerichtsverhandlung/Verhandlungsort. Um das Schiedsverfahren so kostengünstig, effizient und bequem wie möglich zu gestalten, wird jede erforderliche Anhörung in einem Schiedsverfahren, bei dem der Streitwert 1.000.000 US-Dollar nicht übersteigt, per Videokonferenz durchgeführt, es sei denn, die Parteien haben etwas anderes vereinbart oder der/die Schlichter:in hat etwas anderes angeordnet. Jede erforderliche Anhörung in einem Schiedsverfahren, bei dem der Streitwert 1.000.000 US-Dollar übersteigt, wird in San Francisco County durchgeführt, es sei denn, die Parteien haben etwas anderes vereinbart oder der/die Schlichter:in hat etwas anderes angeordnet. Wenn der Streitwert 10.000 US-Dollar oder weniger beträgt, vereinbaren die Parteien, dem/der Schlichter:in ausschließlich Dokumente vorzulegen.

25.8 Änderung der Schiedsgerichtsordnung – Schiedsgerichtsgebühren und -kosten. Ihre Schiedsgebühren und Ihr Anteil an der Vergütung des Schlichters / der Schlichterin werden durch die ADR-Regeln und die Gebührenordnung der ADR Services (verfügbar unter www.adrservices.com) bestimmt. Wenn Sie über ein monatliches Bruttoeinkommen von weniger als 300 % der bundesstaatlichen Armutsrichtlinien verfügen, haben Sie Anspruch auf eine Befreiung von den Schiedsgerichtsgebühren und -kosten, ausgenommen die Gebühren für den/die Schlichter:in. Sie können eine Gebührenbefreiung beantragen, indem Sie der Schlichtungsstelle eine eidesstattliche Erklärung vorlegen, in der Sie Ihr monatliches Einkommen und die Anzahl der Personen in Ihrem Haushalt angeben. Wenn die Schlichtungsstelle eine Gebührenbefreiung gewährt und Sie Airbnb die erforderlichen Unterlagen vorlegen, um nachzuweisen, dass Ihr monatliches Bruttoeinkommen weniger als 300 % der bundesstaatlichen Armutsrichtlinien beträgt, wird Airbnb Ihren Anteil an den Gebühren für den/die Schlichter:in übernehmen.

25.9 Änderung der Schiedsgerichtsordnung – Ansprüche, die zu einem unzulässigen Zweck oder unter Verstoß gegen diese Schiedsvereinbarung erhoben wurden. Jede Partei kann beantragen, dass der/die Schlichter:in Sanktionen verhängt, wenn sie nachweist, dass die andere Partei oder ihr Rechtsbeistand einen Anspruch oder eine Verteidigung geltend gemacht hat, der in tatsächlicher oder rechtlicher Hinsicht unbegründet ist, in böser Absicht oder zum Zweck der Belästigung vorgebracht wurde oder auf andere Weise unseriös ist. Soweit nach geltendem Recht zulässig, verhängt der/die Schlichter:in Sanktionen in Höhe der angemessenen anwaltlichen Honorare und Kosten der antragstellenden Partei, wenn er/sie feststellt, dass ein Anspruch oder eine Verteidigung in tatsächlicher oder rechtlicher Hinsicht unbegründet ist, in böser Absicht oder zum Zweck der Belästigung vorgebracht wurde und gegen die Bestimmungen des Fed. R. Civ. P. 11(b) (Anerkennung des Schlichters / der Schlichterin als „das Gericht“) verstößt oder anderweitig unseriös ist. Jede Partei kann die Abweisung eines Schiedsverfahrens beantragen, das unter Verletzung einer Bestimmung dieser Schiedsvereinbarung eingereicht wurde. Jede Partei kann im Schiedsverfahren eine Gegenforderung für die Einleitung eines Verfahrens der anderen Partei in Bezug auf eine schiedsrichterliche Streitigkeit geltend machen, bei der die Anforderungen dieser Schiedsvereinbarung nicht erfüllt sind oder anderweitig verletzt werden. Stellt der/die Schlichter:in fest, dass eine Partei ein Verfahren in Bezug auf eine schiedsfähige Streitigkeit eingeleitet hat, bei der die Anforderungen dieser Schiedsvereinbarung nicht erfüllt sind oder anderweitig verletzt werden, wird er/sie der anderen Partei den tatsächlichen Schadenersatz zusprechen, einschließlich, aber nicht beschränkt auf angemessene anwaltliche Gebühren und Kosten.

25.10 Entscheidung des Schlichters / der Schlichterin. Der/Die Schlichter:in erlässt eine schriftliche Entscheidung, die die wesentlichen Ergebnisse und Schlussfolgerungen enthält, auf die er/sie den Schiedsspruch stützt. Der Schiedsspruch kann von jedem zuständigen Gericht für vollstreckbar erklärt werden. Der/Die Schlichter:in kann jeglichen gesetzlich oder nach den ADR-Regeln zulässigen Rechtsschutz zusprechen, der Feststellungs- oder Unterlassungsanspruch kann jedoch nur auf individueller Basis und nur in dem Umfang zugesprochen werden, der erforderlich ist, um den durch den individuellen Anspruch des Klägers / der Klägerin gerechtfertigten Rechtsbehelf zu gewähren.

25.11 Verzicht auf Schwurgerichtsverfahren. Sie und Airbnb erkennen an und erklären sich bereit, auf das Recht auf ein Schwurgerichtsverfahren in Bezug auf alle schiedsrichterlichen Streitigkeiten zu verzichten.

25.12 Keine Sammelklagen oder Musterprozesse. Sie und Airbnb erkennen an und stimmen zu, dass jede Seite, soweit rechtlich zulässig, auf das Recht verzichtet, sich als Kläger:in oder Mitglied einer Sammelklägergruppe an einer Sammelklage, einem Sammelschiedsverfahren, einer im öffentlichen Interesse liegenden Privatklage oder einem anderen repräsentativen oder konsolidierten Verfahren zu beteiligen. Sofern wir nicht schriftlich zustimmen oder dies in dieser Vereinbarung vorgesehen ist, darf der/die Schlichter:in nicht die Ansprüche mehrerer Vertragsparteien konsolidieren und darf darüber hinaus in keiner Form einem Sammelverfahren oder repräsentativen Verfahren vorsitzen. Wenn es eine endgültige gerichtliche Feststellung gibt, dass geltendes Recht die Durchsetzung der in diesem Absatz enthaltenen Verzichtserklärung in Bezug auf eine Forderung, einen Klagegrund oder einen beantragten Rechtsbehelf ausschließt, wird diese Forderung, dieser Klagegrund oder dieser beantragte Rechtsbehelf, und nur diese Forderung, dieser Klagegrund oder dieser beantragte Rechtsbehelf, von dieser Schiedsgerichtsvereinbarung abgetrennt und einem zuständigen Gericht vorgelegt. Für den Fall, dass eine Forderung, ein Klagegrund oder ein beantragter Rechtsbehelf gemäß diesem Absatz abgetrennt wird, stimmen Sie und wir zu, dass die Forderungen, Klagegründe oder beantragten Rechtsbehelfe, die nicht Gegenstand eines Schiedsverfahrens sind, ausgesetzt werden, bis alle schiedsfähigen Forderungen, Klagegründe und beantragten Rechtsbehelfe durch den/die Schlichter:in geklärt sind.

25.13 Verzicht auf Sammelklagen. Sie und Airbnb Payments erkennen an und stimmen zu, dass die relativen Vorteile und die Effizienz eines Schiedsverfahrens verloren gehen können, wenn innerhalb von 180 Tagen 100 oder mehr Schiedsklagen eingereicht werden, die (1) dieselben oder ähnlich gelagerte Parteien betreffen; (2) auf denselben oder ähnlichen Ansprüchen beruhen, die sich aus denselben oder im Wesentlichen identischen Transaktionen, Vorfällen, angeblichen Verstößen oder Ereignissen ergeben, wobei dieselben oder im Wesentlichen identischen Rechts- oder Tatsachenfragen zu klären sind; und (3) dieselben oder übereinstimmende Rechtsbeistände der Parteien einbeziehen („Sammelklage“). Dementsprechend erklären Sie und Airbnb sich damit einverstanden, auf das Recht zu verzichten, Streitfälle im Rahmen einer Sammelklage zu verwalten, zu schlichten oder zu lösen (wobei die Ziffern 23 und 25.12 dieser Bedingungen weiterhin für die Streitfälle gelten). Im Falle eines Streitfalles entscheidet der/die ernannte Schlichter:in, der/die für die erste Angelegenheit innerhalb einer von einer der Parteien bezeichneten Gruppe von Ansprüchen bestellt wurde, ob diese Ansprüche Teil einer Sammelklage sind. Wenn noch kein:e Schlichter:in ernannt wurde, wird ein:e Schlichter:in ausschließlich für die Feststellung ernannt, ob die von einer der Parteien genannten Ansprüche Teil einer Sammelklage sind. Keine Bestimmung dieser Vereinbarung hindert Sie oder Airbnb daran, an einer Massenbeilegung von Klagen teilzunehmen.

25.14 Änderung der Schiedsgerichtsordnung – Anforderungen an die Bündelung von Sammelklagen. Wird ein Schiedsverfahren aus irgendeinem Grund ungeachtet der Ziffer 25.13 als Teil einer Massenklage durchgeführt, so fassen die Parteien die Schiedsanträge in Gruppen von nicht mehr als 200 Stück zusammen. Die Gruppen werden durch alphabetische Auflistung der Antragsteller:innen (nach Nachname oder bzw. Firmenname) bestimmt – zum Beispiel bilden die ersten 200 aufgeführten Antragsteller:innen die erste Gruppe, die nächsten 200 aufgeführten Antragsteller:innen die zweite Gruppe usw. Die Parteien weisen jeder Gruppe nach dem Zufallsprinzip eine fortlaufende Nummer zu und schlichten die Gruppen nacheinander in fortlaufender Reihenfolge. Während des Schiedsverfahrens über eine Partie setzt die Schlichtungsstelle das Verfahren für die verbleibenden Partien aus, es sei denn, die Parteien haben etwas anderes vereinbart oder die Schlichtungsstelle hat sie angewiesen. Für jede Gruppe muss das Verfahren innerhalb von 240 Tagen nach der Voranhörungskonferenz für diese Gruppe abgeschlossen sein. Ungeachtet des Vorstehenden können Kläger:innen, wenn ihre Forderung nicht innerhalb von zwei Jahren nach der zuletzt eingereichten Forderung in der Massenklage Gegenstand einer Voranhörungskonferenz war, die in der Forderung der Klägerinnen geltend gemachten Ansprüche vorbehaltlich der Ziffern 23 und 25.12 dieser Nutzungsbedingungen gerichtlich verfolgen.

25.15 Änderungen der Schiedsgerichtsordnung – Angebote zur Urteilsfindung. Mindestens zehn (10) Tage vor dem für die Schiedsgerichtsverhandlung festgelegten Datum können Sie oder Airbnb der anderen Partei ein schriftliches Urteilsangebot unterbreiten, um ein Urteil zu bestimmten Bedingungen zu ermöglichen. Wird das Angebot angenommen, ist es mit dem Nachweis der Annahme dem/der Schlichter:in vorzulegen, der/die einen entsprechenden Schiedsspruch erlässt. Wird das Angebot nicht vor der Schiedsgerichtsverhandlung oder innerhalb von dreißig (30) Tagen nach seiner Abgabe angenommen – je nachdem, was zuerst eintritt –, gilt es als zurückgezogen und kann außer in Bezug auf die Kosten (einschließlich aller an den/die Schlichter:in gezahlten Gebühren) nicht als Beweismittel im Schiedsverfahren vorgelegt werden. Wird ein von einer Partei unterbreitetes Angebot von der anderen Partei nicht angenommen und gelingt es der anderen Partei nicht, einen günstigeren Schiedsspruch zu erwirken, so kann die andere Partei ihre nach dem Angebot entstandenen Kosten nicht zurückfordern und muss die Kosten der anbietenden Partei (einschließlich aller an den/die Schlichter:in gezahlten Gebühren) ab dem Zeitpunkt des Angebots tragen.

25.16 Salvatorische Klausel. Unbeschadet der Regelung in Ziffer 25.11 und für den Fall, dass ein Teil dieser Schiedsvereinbarung als unwirksam oder nicht durchsetzbar eingestuft wird, wird diese unwirksame oder nicht durchsetzbare Bestimmung gestrichen, wobei der übrigen Schiedsvereinbarung volle Rechtskraft zuteil wird.

25.17 Änderungen an der Schiedsvereinbarung. Wenn Airbnb diese Ziffer 25 nach dem Datum ändert, an dem Sie diesen Nutzungsbedingungen (oder späteren Änderungen dieser Nutzungsbedingungen) zuletzt zugestimmt haben, können Sie die Änderung ablehnen, indem Sie uns spätestens 30 Tage nach Inkrafttreten der Änderung eine schriftliche Mitteilung senden. Die Mitteilung muss Ihren Namen, Ihre Postanschrift, das Datum der Mitteilung, den Namen in Ihren Airbnb-Konto, die E-Mail-Adresse, mit der Sie Ihr Airbnb-Konto erstellt haben, Ihre Unterschrift und eine eindeutige Erklärung enthalten, dass Sie die geänderte Ziffer 25 ablehnen. Sie müssen Ihre Mitteilung an eine dieser beiden Adressen senden: 888 Brannan Street, San Francisco, CA 94103, Attn: Arbitration Opt-Out, oder per E-Mail an arbitration.opt.out@airbnb.com. Die Ablehnung einer neuen Änderung widerruft oder ändert jedoch nicht Ihre vorherige Zustimmung zu früheren Schlichtungsvereinbarungen von Streitigkeiten zwischen Ihnen und Airbnb (oder Ihre vorherige Zustimmung zu späteren Änderungen daran), die in Bezug auf Streitigkeiten zwischen Ihnen und Airbnb in Kraft und durchsetzbar bleiben.

25.18 Fortbestehen. Mit Ausnahme des in Ziffer 25.16 Festgelegten und vorbehaltlich Ziffer 12.6 der Nutzungsbedingungen für außereuropäische Nutzer:innen gilt diese Ziffer 25 über die Kündigung dieser Nutzungsbedingungen hinaus fort und ist weiterhin anwendbar, auch wenn Sie die Airbnb-Plattform nicht mehr nutzen oder Ihr Airbnb-Konto kündigen.

Zusätzliche Bedingungen für gewerbliche Gastgeber:innen

Wenn Sie erklären, dass Sie die Airbnb-Plattform nutzen, um Verbraucher:innen Gastgeber:innen-Services zu Zwecken anzubieten, die mit Ihrer gewerblichen, geschäftlichen, handwerklichen oder beruflichen Tätigkeit zusammenhängen („gewerbliche:r Gastgeber:in“), gelten für Sie die folgenden zusätzlichen Bedingungen:

26. Gastgeben als gewerbliche:r Gastgeber:in auf Airbnb.

26.1 Als gewerbliche:r Gastgeber:in verpflichten Sie sich, nur Gastgeber:innen-Services auf der Airbnb-Plattform anzubieten, die den geltenden Vorschriften des EU-Rechts entsprechen.

26.2 Um zwingende gesetzliche Anforderungen zu erfüllen, müssen Sie Airbnb mindestens die folgenden Informationen (sofern zutreffend) zur Verfügung stellen, um als gewerbliche:r Gastgeber:in Gastgeber:innen-Services auf der Airbnb-Plattform anbieten zu können:

  • Ihren Namen, Ihre Anschrift, Ihre Telefonnummer und Ihre E-Mail-Adresse;
  • eine Kopie Ihres Ausweisdokuments oder einer anderen elektronischen Identifizierung im Sinne von Artikel 3 der Verordnung (EU) Nr. 910/2014;
  • die Angaben zu Ihrem Zahlungskonto;
  • das Handelsregister, in dem Sie eingetragen sind, und Ihre Registrierungsnummer oder ein gleichwertiges Identifikationsmerkmal in diesem Register.

26.3 Sie können Gastgeber:innen-Services erst dann auf der Airbnb-Plattform anbieten, wenn Airbnb feststellen konnte, dass die Informationen zuverlässig und vollständig sind. Wir können von Ihnen die Vorlage zusätzlicher Unterlagen verlangen, um die Zuverlässigkeit und Vollständigkeit Ihrer Angaben beurteilen zu können.

26.4 Sie sind für die Richtigkeit der von Ihnen gemachten Angaben verantwortlich und verpflichtet, Ihre Angaben stets auf dem neuesten Stand zu halten. Wenn wir ausreichende Hinweise erhalten oder anderweitig Grund zu der Annahme haben, dass eine Angabe unrichtig, unvollständig oder nicht aktuell ist, werden wir Sie dazu auffordern, die Sachlage unverzüglich zu berichtigen. Wenn Sie Ihre Angaben nicht innerhalb des von uns angegebenen Zeitraums aktualisieren, können wir Ihre Nutzung der Airbnb-Plattform aussetzen, bis Sie die erforderlichen Informationen bereitgestellt haben. Wenn wir unsere Services aus diesen Gründen aussetzen, haben Sie das Recht, eine Beschwerde über unser System zur Bearbeitung von Beschwerden oder bei einer zertifizierten außergerichtlichen Streitbeilegungsstelle gemäß Ziffer 14 dieser Nutzungsbedingungen einzureichen.

27. Bearbeitung von Beschwerden und Mediation.

Wenn Sie als gewerbliche:r Gastgeber:in im EWR oder im Vereinigten Königreich ansässig sind, haben Sie Zugang zu unserem internen System für die Bearbeitung von Beschwerden gewerblicher Gastgeber:innen. Dieses ermöglicht es Ihnen, eine Beschwerde in Bezug auf Angelegenheiten einzureichen, die in den Anwendungsbereich von Artikel 11 der Verordnung (EU) 2019/1150 fallen. Dies beinhaltet auch die Klärung der Tatsachen und Umstände, die zu Maßnahmen gemäß den Ziffern 13.2 und 13.3 dieser Nutzungsbedingungen führen. In unserem Hilfe-Center erfahren Sie, wie Sie als gewerbliche:r Gastgeber:in auf unser internes System für die Bearbeitung von Beschwerden gewerbliche:r Gastgeber:innen zugreifen und was Sie erwarten können, wenn Sie eine Beschwerde einreichen. Dort finden Sie auch die Einzelheiten zu dem Mediations-Service, den Sie in Anspruch nehmen können, falls eine solche Beschwerde nicht geklärt wird.

28. Zugriff auf Daten.

Gewerbliche Gastgeber:innen haben Zugriff auf personenbezogene und andere Daten in ihrem Airbnb-Konto und Gastgeber:innen-Dashboard, die von gewerblichen Gastgeber:innen und ihren Gästen übermittelt oder durch die Nutzung der Airbnb-Plattform generiert werden und die für die Erbringung ihrer Gastgeber:innen-Services erforderlich sind, sowie auf aggregierte Informationen über Suchanfragen, Buchungen und die Leistung ihrer Inserate. Unsere Datenschutzerklärung legt fest, welche Kategorien von personenbezogenen Daten und anderen Daten wir erfassen, wie wir sie verwenden, verarbeiten, weitergeben und speichern und wie Sie darauf zugreifen und Ihre Rechte ausüben können.

29. Zusätzliche Vertriebskanäle.

Airbnb betreibt ein Partnerprogramm, über das Inserate auf externen Websites, z. B. für Online-Reiseportale, Medienseiten, Treueprogramme und Suchdienste, angezeigt werden können. Inserate können auch in Werbung für Airbnb erscheinen, die gelegentlich auf Websites Dritter veröffentlicht wird.

Terms of Service for Non-European Users

Section 23 of these Terms contains an arbitration agreement and class action waiver that apply to all claims brought against Airbnb in the United States. Please read them carefully.

Thank you for using Airbnb!

These Terms of Service (“Terms”) are a binding legal agreement between you and Airbnb that govern your right to use the websites, applications, and other offerings from Airbnb (collectively, the “Airbnb Platform”). When used in these Terms, “Airbnb,” “we,” “us,” or “our” refers to the Airbnb entity set out on Schedule 1 with whom you are contracting.

The Airbnb Platform offers an online venue that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests.” Hosts offer accommodations (“Accommodations”), activities, excursions, and events (“Experiences”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”). You must register an account to access and use many features of the Airbnb Platform, and must keep your account information accurate. As the provider of the Airbnb Platform, Airbnb does not own, control, offer or manage any Listings or Host Services. Airbnb is not a party to the contracts entered into directly between Hosts and Guests, nor is Airbnb a real estate broker, travel agency, or insurer. Airbnb is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service (“Payment Terms”). To learn more about Airbnb’s role see Section 16.

We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the Airbnb payment entities (collectively "Airbnb Payments").

If you are a Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Host Services.

Guest Terms

1. Our Mission.

Our mission is to create a world where you can belong anywhere. From cabins to castles to cooking classes, browse through millions of Listings to find the ones that fit the way you like to travel. Learn more about a Listing by reviewing the description and photos, the Host profile, and Guest reviews. If you have questions, just message the Host.

2. Searching and Booking on Airbnb.

2.1 Searching. You can search for Host Services by using criteria like the type of Host Service, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, Reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more. 2.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like Airbnb’s service fee, offline fees, taxes, and any other items identified during checkout (collectively, “Total Price”). You are also agreeing that Airbnb via Airbnb Payments may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect Damage Claim (as defined in Section 15) amounts. When you receive the booking confirmation, a contract for Host Services (a "Reservation") is formed directly between you and the Host. In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to booking a Listing.Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

2.3 Accommodation Reservations. An Accommodation Reservation is a limited license to enter, occupy, and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) consistent with applicable law. If you stay past checkout, the Host has the right to make you leave in a manner consistent with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

2.4 Reservations for Experiences and Other Host Services. An Experience or other Host Service Reservation entitles you to participate in, attend, or use that Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness, or other requirements. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend, or use the Host Service. Except where expressly authorized, you may not allow any person to join a Host Service unless they are included as an additional guest during the booking process.

3. Cancellations, Travel Issues, Refunds and Booking Modifications.

3.1 Cancellations, Travel Issues, and Refunds. In general, if as a Guest you cancel a Reservation, the amount refunded to you is determined by the cancellation policy that applies to that Reservation. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control forces you to cancel a Reservation, you may be eligible for a partial or full refund under our Extenuating Circumstances Policy. If the Host cancels, or you experience a Travel Issue (as defined in our Guest Refund Policy), you may be eligible for rebooking assistance or a partial or full refund under the Guest Refund Policy. Different policies apply to certain categories of Listings; for example Experiences Reservations are governed by the Experiences Guest Refund Policy. See each Additional Legal Term or Policy for details about what is covered, and what refund applies in each situation.

3.2 Booking Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf ("Booking Modifications"), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification.

4. Your Responsibilities and Assumption of Risk.

4.1 Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, Experience or other Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Claim amounts necessary to cover damage that you, your guest(s), or your pet(s) cause to an Accommodation, and (iii) you must act with integrity, treat others with respect, and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

4.2 Your Assumption of Risk. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Airbnb Platform and any Content (as defined in Section 10), including your stay at any Accommodation, participation in any Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

Host Terms

5. Hosting on Airbnb.

5.1 Host. As a Host, Airbnb offers you the right to use the Airbnb Platform to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests - and earn money doing it. It’s easy to create a Listing and you are in control of how you host - set your price, availability, and rules for each Listing.

5.2 Contracting with Guests. When you accept a booking request, or receive a booking confirmation through the Airbnb Platform, you are entering into a contract directly with the Guest, and are responsible for delivering your Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like Airbnb’s service fee (and applicable taxes) for each booking. Airbnb Payments will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms, policies or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Additional Legal Terms, Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

5.3 Independence of Hosts. Your relationship with Airbnb is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of Airbnb, except that Airbnb Payments acts as a payment collection agent as described in the Payments Terms. Airbnb does not direct or control your Host Service, and you agree that you have complete discretion whether and when to provide Host Services, and at what price and on what terms to offer them.

6. Managing Your Listing.

6.1 Creating and Managing Your Listing. The Airbnb Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Host Service, your price, other charges like cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your Guests or Listing. You are responsible for keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. We recommend that you obtain appropriate insurance for your Host Services and suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay. Any offer of an Experience is subject to our Additional Terms for Experience Hosts.

6.2 Know Your Legal Obligations. You are responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours, or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

6.3 Search Ranking. The ranking of Listings in search results on the Airbnb Platform depends on a variety of factors, including these main parameters:

  • Guest search parameters (e.g. number of Guests, time and duration of the trip, price range),
  • Listing characteristics (e.g. price, calendar availability, number and quality of images, Reviews, type of Host Service, Host status, age of the Listing, average Guest popularity),
  • Guest booking experience (e.g. customer service and cancellation history of the Host, ease of booking),
  • Host requirements (e.g. minimum or maximum nights, booking cut-off time), and
  • Guest preferences (e.g. previous trips, saved Listings, location from where the Guest is searching).

Search results may appear different on our mobile application than they appear on our website. Airbnb may allow Hosts to promote their Listings in search or elsewhere on the Airbnb Platform by paying an additional fee. More information about the factors that determine how your Listing appears in search results, our current promotional programs (if any), and how we identify promoted Content can be found in our Help Center.

6.4 Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Airbnb Platform except those expressly authorized by our Offline Fee Policy. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Airbnb Platform in violation of our Off-Platform Policy.

6.5 Hosting as a Team or Organization. If you work with a co-host or host as part of a team, business, or other organization, the entity and each individual who participates in providing Host Services is responsible and liable as a Host under these Terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Airbnb to transfer a portion of your payout to a co-host or other Hosts, or to send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

6.6 Your Assumption of Risk. You acknowledge that hosting carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Airbnb Platform, offering Host Services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the Airbnb Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services and that you are not relying upon any statement of law made by Airbnb.

7. Cancellations, Travel Issues, and Booking Modifications.

7.1 Cancellations and Travel Issues. In general, if a Guest cancels a Reservation, the amount paid to you is determined by the cancellation policy that applies to that Reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason, we may impose a cancellation fee and other consequences. If: (i) a Guest experiences a Travel Issue (as defined by the Guest Refund Policy), (ii) an Extenuating Circumstance arises, or (iii) a Reservation is cancelled under Section 13 of these Terms, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Airbnb exceeds your payout, Airbnb (via Airbnb Payments) may recover that amount from you, including by offsetting the refund against your future payouts. You agree that Airbnb’s Guest Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a Reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that Reservation until a refund decision is made. If you Host an Experience please note that the Experience Cancellation Policy, Experiences Guest Refund Policy and different cancellation fees and consequences apply to your Reservations. See each Policy for details about what is covered, and what your payout will be in each situation.

7.2 Booking Modifications. Hosts and Guests are responsible for any Booking Modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification.

8. Taxes.

8.1 Host Taxes. As a host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income, or other taxes ("Taxes").

8.2 Collection and Remittance by Airbnb. In jurisdictions where Airbnb facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize Airbnb to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Airbnb are identified to Members on their transaction records, as applicable. Airbnb may seek additional amounts from Members (including by deducting such amounts from future payouts) in the event that the Taxes collected and/or remitted are insufficient to fully discharge that Members’ tax obligations, and you agree that your sole remedy for Taxes collected by Airbnb is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

8.3 Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Airbnb may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Host Services to facilitate accurate tax reporting by you, our Guests, and/or their organizations.

General Terms

9. Reviews.

After each Host Service, Guests and Hosts will have an opportunity to review each other. Your Review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our Content Policy or Review Policy. Reviews are not verified by Airbnb for accuracy and may be incorrect or misleading.

10. Content.

Parts of the Airbnb Platform enable you to provide feedback, text, photos, audio, video, information, and other content (collectively, “Content”). By providing Content, in whatever form and through whatever means, you grant Airbnb a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sub-licensable and transferable license to copy, modify, prepare derivative works of, distribute, publish and otherwise exploit, that Content, without limitation. If Content includes personal information, our Privacy Policy describes how we use that personal information. Where Airbnb pays for the creation of Content or facilitates its creation, Airbnb may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Airbnb the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent, and illegal content. You agree that Airbnb may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. Airbnb does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

11. Fees.

Airbnb may charge fees (and applicable Taxes) to Hosts and Guests for the right to use the Airbnb Platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Except as otherwise provided on the Airbnb Platform, service fees are non-refundable. Airbnb reserves the right to change the service fees at any time, and will provide Members notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time pursuant to Section 13.2.

12. Airbnb Platform Rules.

12.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect
    • Do not lie, misrepresent something or someone, or pretend to be someone else.
    • Be polite and respectful when you communicate or interact with others.
    • Follow our Nondiscrimination Policy and do not discriminate against or harass others.
  • Do not scrape, hack, reverse engineer, compromise or impair the Airbnb Platform
    • Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Airbnb Platform.
    • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Airbnb Platform or Content.
    • Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Airbnb Platform.
    • Do not take any action that could damage or adversely affect the performance or proper functioning of the Airbnb Platform.
  • Only use the Airbnb Platform as authorized by these Terms or another agreement with us
    • You may only use another Member’s personal information as necessary to facilitate a transaction using the Airbnb Platform as authorized by these Terms.
    • Do not use the Airbnb Platform, our messaging tools, or Members’ personal information to send commercial messages without the recipient’s express consent.
    • You may use Content made available through the Airbnb Platform solely as necessary to enable your use of the Airbnb Platform as a Guest or Host.
    • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
    • Do not request, make, or accept a booking or any payment outside of the Airbnb Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.
    • Do not require or encourage Guests to open an account, leave a review, complete a survey, or otherwise interact, with a third party website, application or service before, during or after a Reservation, unless authorized by Airbnb.
    • Do not engage in any practices that are intended to manipulate our search algorithm.
    • Do not book Host Services unless you are actually using the Host Services.
    • Do not use, copy, display, mirror or frame the Airbnb Platform, any Content, any Airbnb branding, or any page layout or design without our consent.
  • Honor your legal obligations
    • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
    • If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
    • Read and follow our Terms, Additional Legal Terms, Policies, and Standards.
    • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.
    • Do not use the name, logo, branding, or trademarks of Airbnb or others without permission.
    • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that may be confused with Airbnb branding.
    • Do not offer Host Services that violate the laws or agreements that apply to you.
    • Do not offer or solicit prostitution or participate in or facilitate human trafficking.

12.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Airbnb. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to Airbnb. If you reported an issue to local authorities, Airbnb may request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

12.3 Copyright Notifications. If you believe that Content on the Airbnb Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

13. Termination, Suspension and other Measures.

13.1 Term. The agreement between you and Airbnb reflected by these Terms is effective when you access the Airbnb Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

13.2 Termination. You may terminate this agreement at any time by sending us an email or by deleting your account. Airbnb may terminate this agreement and your account for any reason by giving you 30 days’ notice via email or using any other contact information you have provided for your account. Airbnb may also terminate this agreement immediately and without notice and stop providing access to the Airbnb Platform if you breach these Terms, you violate our Additional Legal Terms, or Policies, you violate applicable laws, or we reasonably believe termination is necessary to protect Airbnb, its Members, or third parties. If your account has been inactive for more than two years, we may terminate your account without prior notice.

13.3 Member Violations. If (i) you breach these Terms, our Additional Legal Terms, Policies, or our Standards, (ii) you violate applicable laws, regulations, or third-party rights, or (iii) Airbnb believes it is reasonably necessary to protect Airbnb, its Members, or third parties; Airbnb may, with or without prior notice:

  • suspend or limit your access to or use of the Airbnb Platform and/or your account;
  • suspend or remove Listings, Reviews, or other Content;
  • cancel pending or confirmed bookings; or
  • suspend or revoke any special status associated with your account.

For minor violations or where otherwise appropriate as Airbnb determines in its sole discretion, you will be given notice of any intended measure by Airbnb and an opportunity to resolve the issue. You may appeal actions taken by us under this Section by contacting customer service. If a Reservation is cancelled under this Section, the amount paid to the Host will be reduced by the amount we refund or otherwise provide to the Guest, and by any other costs we incur as a result of the cancellation.

13.4 Legal Mandates. Airbnb may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, including the measures described above in Section 13.3.

13.5 Effect of Termination. If you are a Host and terminate your Airbnb account, any confirmed booking(s) will be automatically cancelled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Reservation’s cancellation policy. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the Airbnb Platform has been limited, or your Airbnb account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Airbnb Platform through an account of another Member.

13.6 Survival. Parts of these Terms that by their nature survive termination, will survive termination of this agreement, including Sections 2 through 26.

14. Modification.

Airbnb may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of any material changes by email at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Airbnb Platform will constitute acceptance of the revised Terms.

15. Resolving Complaints and Damage Claims.

If a Member provides valid evidence that you, your guest(s), or your pet(s)damaged the complaining Member’s real or personal property, or real or personal property the complaining Member is responsible for, including consequential damages, ("Damage Claim"), the complaining Member can notify Airbnb and/or seek compensation through the Resolution Center. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Airbnb and Airbnb determines in its sole discretion that the Damage Claim is valid and you are responsible for the Damage Claim, Airbnb via Airbnb Payments can collect the amount of the Damage Claim from you. You agree that Airbnb may seek to recover from you under any insurance policies you maintain and that Airbnb may also pursue against you any remedies it may have available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against you. You agree to cooperate in good faith, provide any information Airbnb requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

16. Airbnb’s Role.

We offer you the right to use a platform that enables Members to publish, offer, search for, and book Host Services. While we work hard to ensure our Members have great experiences using Airbnb, we do not and cannot control the conduct of Guests and Hosts. You acknowledge that Airbnb has the right, but does not have any obligation, to monitor the use of the Airbnb Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Airbnb Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Members acknowledge and agree that Airbnb administers its Additional Legal Terms, Policies (such as our Extenuating Circumstances Policy) and Standards (such as basic requirements for hosts), including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist Airbnb in good faith, and to provide Airbnb with such information and take such actions as may be reasonably requested by Airbnb with respect to any investigation undertaken by Airbnb regarding the use or abuse of the Airbnb Platform. Airbnb is not acting as an agent for any Member except for where Airbnb Payments acts as a collection agent as provided in the Payments Terms.

17. Member Accounts.

You must register an account to access and use many features of the Airbnb Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Airbnb Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify Airbnb if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

18. Disclaimer of Warranties.

We provide the Airbnb Platform and all Content “as is” without warranty of any kind and we disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or third party; (ii) we do not warrant the performance or non-interruption of the Airbnb Platform; and (iii) we do not warrant that verification, identity or background checks conducted on Listings or Members (if any) will identify past misconduct or prevent future misconduct. Any references to a Member or Listing being "verified" (or similar language) indicate only that the Member or Listing or Airbnb has completed a relevant verification or identification process and nothing else. The disclaimers in these Terms apply to the maximum extent permitted by law. If you have statutory rights or warranties we cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

19. Limitations on Liability.

Neither Airbnb (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Airbnb Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Airbnb Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Airbnb Platform, or (iv) publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Airbnb has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

Except for our obligation to transmit payments to Hosts under these Terms, or make payments under the Airbnb Host Damage Protection or Japan Host Insurance, in no event will Airbnb’s aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the Airbnb Platform, any Content, or any Host Service, exceed: (A) to Guests, the amount you paid as a Guest during the 12-month period prior to the event giving rise to the liability, (B) to Hosts, the amount paid to you as a Host in the 12-month period prior to the event giving rise to the liability, or (C) to anyone else, one hundred U.S. dollars (US$100).

These limitations of liability and damages are fundamental elements of the agreement between you and Airbnb. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.

20. Indemnification.

To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb’s option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our

Additional Legal TermsPolicies or Standards, (ii) your improper use of the Airbnb Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in an Experience or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.

21. Contracting Entities.

Based on your country of residence or establishment and what you are doing on the Airbnb Platform, Schedule 1 below sets out the Airbnb entity with whom you are contracting. If we identify through the Airbnb Platform, an Airbnb entity other than the one set out on Schedule 1 as being responsible for a product, feature or transaction, the Airbnb entity so identified is your contracting entity with respect to that product, feature or transaction. If you change your country of residence or establishment, the Airbnb company you contract with (as set out on Schedule 1) and the applicable version of the Terms of Service will be determined by your new country of residence or establishment, from the date on which your country of residence or establishment changes.

22. United States Governing Law and Venue.

If you reside or have your place of establishment in the United States, these Terms will be interpreted in accordance with the laws of the State of California and the United States of America, without regard to conflict-of-law provisions. Judicial proceedings (other than small claims actions) that are excluded from the arbitration agreement in Section 23 must be brought in state or federal court in San Francisco, California, unless we both agree to some other location. You and we both consent to venue and personal jurisdiction in San Francisco, California.

23. United States Dispute Resolution and Arbitration Agreement.

23.1 Application. This Arbitration Agreement only applies to you if your country of residence or establishment is the United States. If your country of residence or establishment is not the United States, and you nevertheless attempt to bring any legal claim against Airbnb in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 23 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

23.2 Overview of Dispute Resolution Process. Airbnb is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms provide for a two-part process for individuals to whom this Section 23 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in paragraph 23.3, below), and if necessary (2) a binding arbitration administered by the American Arbitration Association (“AAA”). You and Airbnb each retain the right to seek relief in small claims court as an alternative to arbitration.

23.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb each agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. You must send your notice of dispute to Airbnb by mailing it to Airbnb’s agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb will send its notice of dispute to the email address associated with your Airbnb account. A notice of dispute must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (available at www.adr.org) with the AAA and providing a copy to the other party as specified in the AAA Rules (available at www.adr.org).

23.4 Agreement to Arbitrate. You and Airbnb mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Airbnb Platform, Host Services, or any Content (collectively, “Disputes”) will be settled by binding individual arbitration (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb agree that the arbitrator will decide that issue.

23.5 Exceptions to Arbitration Agreement. You and Airbnb each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 22): (i) any claim or cause of action alleging actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; (ii) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); or (iii) a request for the remedy of public injunctive relief; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb agree that the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

23.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this provision. The arbitration will be administered by AAA in accordance with the Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the AAA (the “AAA Rules“) then in effect, except as modified here. The AAA Rules are available at www.adr.org. In order to initiate arbitration, a completed written demand (available at www.adr.org) must be filed with the AAA and provided to the other party, as specified in the AAA rules.

23.7 Modification to AAA Rules - Arbitration Hearing/Location. In order to make the arbitration most convenient to you, Airbnb agrees that any required arbitration hearing may be conducted, at your option: (a) in the U.S. county where you reside; (b) in San Francisco County; (c) via phone or video conference; or (d) if all parties agree, by solely the submission of documents to the arbitrator.

23.8 Modification of AAA Rules - Attorney’s Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. If such costs are determined by the arbitrator to be excessive, Airbnb will pay all arbitration fees and expenses. Either party may make a request that the arbitrator award attorneys’ fees and costs upon proving that the other party has asserted a claim, cross-claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous, as allowed by applicable law and the AAA Rules.

23.9 Arbitrator’s Decision. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

23.10 Jury Trial Waiver. You and Airbnb acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

23.11 No Class Actions or Representative Proceedings. You and Airbnb acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

23.12 Severability. Except as provided in Section 23.11, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision will be severed and the remainder of the Arbitration Agreement will be given full force and effect.

23.13 Changes to Agreement to Arbitrate. If Airbnb changes this Section 23 after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject that change by sending us written notice (including by email) within 30 days of the date the change is effective. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb.

23.14 Survival. Except as provided in Section 23.12 and subject to Section 13.6, this Section 23 will survive any termination of these Terms and will continue to apply even if you stop using the Airbnb Platform or terminate your Airbnb account.

24. China Governing Law and Dispute Resolution.

24.1 China Domestic Transactions. If you reside or have your place of establishment in China, and are contracting with Airbnb China, these Terms and this Section 24.1 are governed by the laws of the People’s Republic of China. In this situation, any dispute arising from or in connection with these Terms or use of the Airbnb Platform shall be submitted to the China International Economic and Trade Arbitration Commission (“CIETAC”) for arbitration which shall be conducted in accordance with the Commission’s arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties. The tribunal shall consist of three (3) arbitrators. The seat of the arbitration shall be Beijing. The language of the arbitration shall be English.

24.2 Cross-border Transactions. If you reside or have your place of establishment in China, and are contracting with Airbnb, Inc., Airbnb Travel, LLC, Airbnb Ireland UC, or any other non-China entity, these Terms and this Section 24.2 are governed by the laws of Singapore. In this situation, any dispute arising out of or in connection with these Terms or use of the Airbnb Platform, including any question regarding the existence, validity or termination of these Terms, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of three (3) arbitrators. The language of the arbitration shall be English.

24.3 Without Limitation Provisions. The above Sections 24.1 and 24.2 are expressed to be without regard to conflict of laws provisions and shall not be construed to limit any rights which Airbnb may have to apply to any court of competent jurisdiction for any order requiring you to perform or be prohibited from performing certain acts and other provisional relief permitted under the laws of Singapore, the People’s Republic of China, or any other laws that may apply to you.

25. Brazil Governing Law and Venue. If you reside or have your place of establishment in Brazil, these Terms will be interpreted in accordance with the laws of Brazil, without regard to conflict-of-law provisions. Legal proceedings that you are able to bring against us arising from or in connection with these Terms may only be brought in a court located in Brazil.

26. Rest of World Dispute Resolution, Venue and Forum, and Governing Law. If you reside or have your place of establishment outside of the United States, China, and Brazil, this Section applies to you and these Terms will be interpreted in accordance with Irish law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. If you are acting as an individual consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. As an individual consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Irish courts.

27. Miscellaneous.

27.1 Other Terms Incorporated by Reference. Our Host Damage Protection, Japan Host Insurance Terms, Guest Refund Policy, Experiences Guest Refund Policy, Content Policy, Nondiscrimination Policy, Extenuating Circumstances PolicyAdditional Legal Terms, PoliciesStandards and other supplemental policies and terms linked to in these Terms apply to your use of the Airbnb Platform, are incorporated by reference, and form part of your agreement with Airbnb.

27.2 Interpreting these Terms. Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms (including those items incorporated by reference) constitute the entire agreement between Airbnb and you pertaining to your access to or use of the Airbnb Platform and supersede any and all prior oral or written understandings or agreements between Airbnb and you. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and Airbnb. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise indicated in Section 23.11 above, such provision will be struck and will not affect the validity and enforceability of the remaining provisions. Where the word “will” is used in these Terms it connotes an obligation with the same meaning as “shall.”

27.3 No Waiver. Airbnb’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

27.4 Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations hereunder without Airbnb's prior written consent. Airbnb may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice.

27.5 Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by Airbnb via email, Airbnb Platform notification, messaging service (including SMS and WeChat), or any other contact method we enable and you provide. If a notification relates to a booking or Listing in Japan, you agree and acknowledge that such notifications via electronic means in lieu of a written statement, satisfies Airbnb’s obligations under Article 59 (1) of the Japanese Housing Accommodation Business Act.

27.6 Third-Party Services. The Airbnb Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Airbnb is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

27.7 Google Terms. Some translations on the Airbnb Platform are powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and non-infringement. Some areas of the Airbnb Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

27.8 Apple Terms. If you access or download our application from the Apple App Store, you agree to Apple’s Licensed Application End User License Agreement.

27.9 Airbnb Platform Content. Content made available through the Airbnb Platform may be protected by copyright, trademark, and/or other laws of the United States and other countries. You acknowledge that all intellectual property rights for that Content are the exclusive property of Airbnb and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Content accessed through the Airbnb Platform except to the extent you are the legal owner of that Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, Airbnb grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Content made available on or through the Airbnb Platform and accessible to you, solely for your personal and non-commercial use.

27.10 Airbnb.org. Airbnb.org is a nonprofit corporation exempt from income taxation under U.S. Internal Revenue Code Section 501(c)(3), operating as a public charity. Airbnb.org is not owned or controlled by Airbnb. Airbnb.org administers a number of charitable programs that benefit our Host and Guest communities and the public.

27.11 Force Majeure. Airbnb shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

27.12 Emails and SMS. You will receive administrative communications from us using the email address or other contact information you provide for your Airbnb account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from us. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have an Airbnb account. In the U.S. if you consent to receive SMS (text messages) from us, you will be subject to our SMS Terms.

Terms of Service for Australian Users

These Terms of Service for Australian Users (“Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. These Terms (including Sections 1.3, 3, 5.3, 5.4, 5.5, 10, 17, 18 and 19) apply to the maximum extent permitted by the Australian Consumer Law.

Section 23 of these Terms contains an arbitration agreement and class action waiver that applies to all claims brought against Airbnb in the United States. Please read them carefully.

These Terms and the documents, policies and standards referred to within them, form a binding legal agreement between you and Airbnb that governs your right to use the websites, applications, and other offerings from Airbnb (collectively, the “Airbnb Platform”).

The documents referred to within these Terms include but are not limited to our:

  • Payments Terms of Service, which govern any payment services provided to Members by the Airbnb payment entities (such entities, collectively, "Airbnb Payments").
  • Privacy Policy, which describes our collection and use of personal data.
  • Service Fees Policy, which describes how Airbnb service fees are charged to Hosts and Guests.
  • Offline Fee Policy, which describes the circumstances in which a Host can charge additional fees or charges outside the Airbnb Platform.
  • Off-Platform Policy, which prohibits certain actions from occurring outside of the Airbnb Platform.
  • Taxes Policy, which explains what taxes may apply to a Reservation.
  • Host Privacy Standards, that specify how Hosts should handle Guest Personal Information.
  • Cancellation Policies, that explain the cancellation policies that may apply to a listing. The Host’s cancellation policy applicable to each reservation is displayed on the Listing page before booking.
  • Extenuating Circumstances Policy, which explains how cancellations are handled when unforeseen events beyond your control arise after booking and make it impractical or illegal to complete your Reservation.
  • Rebooking and Refund Policy, which explains how Airbnb will assist with rebooking a reservation and how Airbnb handles refunds when a Host cancels a reservation or another Reservation Issue disrupts a stay.
  • Experiences Guest Refund Policy, which explains how refunds are handled for Experiences when a Host cancels or a Reservation Issue occurs.
  • Resolution Centre page, which describes how money-related disputes between Hosts and Guests may be resolved.
  • Host Damage Protection Terms, which explains the terms, exclusions and limitations under which Airbnb will agree to pay a Host to repair or replace Covered Property as a result of a Covered Loss.

  • Listing Management Terms of Service, which govern the use of Teams to help manage Listings and provide Host Services.

For convenience, we have set out above several terms and policies that are referred to in these Terms. However, it is important that you note that there are other supplemental policies and terms linked from our Legal Terms and Policies pages, which apply to your use of the Airbnb Platform, and are incorporated by reference, and form part of the binding legal agreement between you and Airbnb.

When used in these Terms, “Airbnb,” “we,” “us,” or “our” refers to the Airbnb entity set out on Schedule 1 with whom you are contracting.

The Airbnb Platform offers an online venue that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests". Hosts offer accommodations (“Accommodations”), activities, excursions and events (“Experiences”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”).

As the provider of the Airbnb Platform, Airbnb does not own, control, offer or manage any Listings, Host Services, or tourism services. Airbnb is not a party to the contracts entered into directly between Hosts and Guests, nor is Airbnb a real estate broker, travel agency, or insurer. Airbnb is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service (“Payment Terms”). To learn more about Airbnb’s role see Section 15.

Guest Terms

1. Searching and Booking on Airbnb.

1.1 Searching. You can search for Host Services by using criteria like the type of Host Service, type of listing, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more. 1.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like Airbnb’s service fee, offline fees, taxes, and any other items identified during checkout (collectively, “Total Price”). If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you prior to you completing payment is based on a currency conversion rate determined by us. You are also agreeing that Airbnb via Airbnb Payments may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect Damage Claim (as defined in Section 14) amounts. If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you is based on a currency conversion rate determined by us. When you receive the booking confirmation, a contract for Host Services (a "Reservation") is formed directly between you and the Host. By making a Reservation you are agreeing to the terms of the contract. The terms of the contract include these Terms, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these terms of the contract including these Terms and all terms of the Reservation including all rules, standards, policies, and requirements prior to booking a Listing. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

1.3 Accommodation Reservations. An Accommodation Reservation is a limited license to enter, occupy and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) permitted by applicable law. If you stay past checkout, the Host has the right to make you leave in a manner permitted by applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

1.4 Reservations for Experiences and Other Host Services. An Experience or other Host Service Reservation entitles you to participate in, attend, or use that Experience or Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness or other requirements. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend or use the Experience or Host Service. Except where expressly authorized, you may not allow any person to join an Experience or Host Service unless they are included as an additional guest during the booking process.

2. Cancellations, Reservation Issues, Refunds and Booking Modifications.

2.1 Cancellations, Reservation Issues, and Refunds. In general, if you cancel a Reservation, the amount refunded to you is determined by the Host’s cancellation policy that applies to that Reservation, as displayed on the Listing page at the time of booking. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control requires you to cancel a Reservation, you may be entitled to a partial or full refund under our Extenuating Circumstances Policy. If the Host cancels, or you experience a Reservation Issue (as defined in our Rebooking and Refund Policy), you may be entitled to rebooking assistance or a partial or full refund under our Rebooking and Refund Policy. Different policies apply to certain categories of Listings; for example, Experiences reservations are governed by the Experiences Guest Refund Policy. See each Additional Legal Term or Policy for details about what is covered, and what refund applies in each situation. You may appeal a decision by Airbnb by contacting our customer service.

2.2 Booking Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf ("Booking Modifications"), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification, which are notified to them prior to choosing to proceed with the Booking Modification.

3. Your Responsibilities and Assumption of Risk.

3.1 Your Responsibilities. To the maximum extent permitted by law, you are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Guest are legally entitled to use in connection with the Accommodation (“Common Areas”), or any Experience or other Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) or Common Areas in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Claim amounts, and (iii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

3.2 Your Assumption of RiskYou acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the risk arising out of your access to and use of the Airbnb Platform and any Content (as defined in Section 9), including your stay at any Accommodation, participation in any Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

Host Terms

4. Hosting on Airbnb.

4.1 Host. As a Host, Airbnb offers you the right to use the Airbnb Platform in accordance with these Terms to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests - and earn money doing it. It’s easy to create a Listing and you are in control of how you host - set your price, availability, and rules for each Listing.

4.2 Contracting with Guests. When you accept a booking request, or receive a booking confirmation through the Airbnb Platform, you are entering into a contract directly with the Guest, and are responsible for delivering the Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like Airbnb’s service fee (and applicable taxes) for each booking. Airbnb Payments will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Additional Legal Terms, Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

4.3 Independence of Hosts. Your relationship with Airbnb is that of an independent individual or entity and not an employee, agent, joint venturer or partner of Airbnb, except that Airbnb Payments acts as a payment collection agent as described in the Payments Terms. Airbnb does not direct or control your Host Service and you understand that you have complete discretion whether and when to provide Host Services and at what price and on what terms to offer them.

5. Managing Your Listing.

5.1 Creating and Managing Your Listing. The Airbnb Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Host Service, your price, other charges like cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your Guests or Listing. You are responsible for your acts and omissions as well as for keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. You are responsible for obtaining appropriate insurance for your Host Services and we suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay. Any offer of an Experience is subject to our Additional Terms for Experience Hosts in Section 24.

5.2 Know Your Legal Obligations. You are responsible for understanding and complying with any laws, rules, regulations and contracts with third parties that apply to your Listing or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

5.3 Search Ranking. The ranking of Listings in search results on the Airbnb Platform depends on a variety of factors, including these main parameters:

  • Guest search parameters (e.g. number of Guests, destination, time and duration of the trip, price range),
  • Listing characteristics (e.g. location, price, calendar availability, number and quality of images, reviews, ratings and other quality signals, type or category of Host Service, Host status, length of time the Listing has been live on the Airbnb Platform, Guest engagement and popularity),
  • Guest experience (e.g. customer service and cancellation history of the Host, ease of booking),
  • Host and Listing requirements (e.g. minimum or maximum nights, booking cut-off time), and
  • Guest preferences and history (e.g. previous trips, viewed and saved Listings, location from where the Guest is searching).

Search results may be different on our mobile application than on our website, and may also differ in the map view. Airbnb may allow Hosts to promote their Listings in search or elsewhere on the Airbnb Platform by paying an additional fee. More information about the factors that determine how your Listing appears in search results, our current promotional programs (if any) and how we identify promoted Content can be found in our Help Center.

5.4 Your Responsibilities. To the maximum extent permitted by law, you are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Airbnb Platform except those expressly authorized by our Offline Fee Policy. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Airbnb Platform in violation of our Off-Platform Policy.

5.5 Hosting as a Team or Organization. To the maximum extent permitted by law, if you work with a co-host or host as part of a team, business or other organization, you are responsible and liable as a Host under these terms for the acts and omission of each entity and individual who participates in providing your Host Services and you are required to inform personnel engaged by you to deliver any Host Services of your obligations under these Terms. If you accept terms or enter into contracts with third parties, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Airbnb to transfer a portion of your payout to a co-host or other Hosts, or send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

5.6 Your Assumption of Risk. You acknowledge that hosting carries inherent risks and agree that, to the maximum extent permitted by law, you assume the risk arising out of your access to and use of the Airbnb Platform, offering Host Services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the Airbnb Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services.

6. Cancellations, Reservation Issues, and Booking Modifications.

6.1 Cancellations and Reservation Issues. In general, if a Guest cancels a Reservation, the amount paid to you is determined by the cancellation policy that applies to that Reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason, we may impose a cancellation fee and other consequences. If: (i) a Guest experiences a Reservation Issue (as defined by the Rebooking and Refund Policy), (ii) an Extenuating Circumstance arises, or (iii) a Reservation is cancelled under Section 12 of these Terms, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Airbnb exceeds your payout, Airbnb (via Airbnb Payments) may recover that amount from you, including by deducting the refund against your future payouts. You agree that Airbnb’s Rebooking and Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a Reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that Reservation until a refund decision is made. If you host an Experience please note that the Experience Cancellation Policy, Experiences Guest Refund Policy and different cancellation fees and consequences apply to your Reservations. See each Policy for details about what is covered, and what your payout will be in each situation.

You may appeal a decision by Airbnb by contacting our customer service.

6.2 Booking Modifications. Hosts and Guests are responsible for any Booking Modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification which are notified to them prior to choosing to proceed with the Booking Modification.

7. Taxes.

7.1 Host Taxes. As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit or include in your price any applicable GST or other indirect taxes, occupancy taxes, sales, tourist or other taxes ("Taxes").

7.2 Collection and Remittance by Airbnb. In jurisdictions where Airbnb facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize Airbnb to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Airbnb are identified to Members on their transaction records, as applicable. Airbnb may seek additional amounts from Members (including by deducting such amounts from future payouts) where Taxes collected and/or remitted are insufficient to fully discharge that Members’ tax obligations, and you agree that your sole remedy for Taxes collected by Airbnb is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

7.3 Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. Where applicable, if you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Airbnb may issue on your behalf invoices or similar documentation for GST or other Taxes for your Host Services to facilitate accurate tax reporting.

General Terms

8. Reviews.

After each Host Service, Guests and Hosts will have an opportunity to review each other. Your review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates these Terms, applicable law, or our Content Policy or Review Policy. Reviews are not verified by Airbnb for accuracy and may be incorrect or misleading.

9. Content.

Parts of the Airbnb Platform enable you to provide feedback, text, photos, audio, video, information and other content (“Content”). By providing Content, in whatever form and through whatever means, you grant Airbnb a non-exclusive, worldwide, royalty-free, perpetual, sub-licensable and transferable license, to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit in any manner such Content to provide and/or promote the Airbnb Platform, in any media or platform, known or unknown to date and in particular on Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. Where Airbnb pays for the creation of Content or facilitates its creation, Airbnb may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Airbnb the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent and illegal content. You agree that Airbnb may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. Airbnb does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

10. Fees.

Airbnb may charge fees (and applicable Taxes) to Hosts and Guests for the right to use the Airbnb Platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Any applicable fees are disclosed to Guests before making a booking. Except as otherwise provided on the Airbnb Platform and to the extent permitted by law, service fees are non-refundable. Airbnb reserves the right to change the service fees at any time, and will provide Members at least 30 days’ notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time pursuant to Section 12.2.

11. Airbnb Platform Rules.

11.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect.
    • Do not lie, misrepresent something or someone, or pretend to be someone else.
    • Be polite and respectful when you communicate or interact with others.
    • Do not attempt to evade enforcement of these Terms, our Additional Legal Terms, Policies, or our Standards, such as by creating a duplicate account or listings.
    • Follow our Nondiscrimination Policy and do not discriminate against or harass others.
  • Do not scrape, hack, reverse engineer, compromise or impair the Airbnb Platform.
    • Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Airbnb Platform.
    • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Airbnb Platform or Content.
    • Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Airbnb Platform.
    • Do not take any action that could damage or adversely affect the performance or proper functioning of the Airbnb Platform.
  • Only use the Airbnb Platform as authorized by these Terms or another agreement with us.
    • You may only use another Member’s personal information as necessary to facilitate a transaction using the Airbnb Platform as authorized by these Terms.
    • Do not use the Airbnb Platform, our messaging tools, or Members’ personal information to send commercial messages without their express consent.
    • You may use Content made available through the Airbnb Platform solely as necessary to enable your use of the Airbnb Platform as a Guest or Host.
    • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
    • Do not request, make or accept a booking or any payment outside of the Airbnb Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.
    • Do not require or encourage Guests to open an account, leave a review, complete a survey, complete a survey, or otherwise interact, with a third party website, application or service before, during or after a Reservation, unless authorized by Airbnb.
    • Do not engage in any practices that are intended to manipulate our search algorithm.
    • Do not book Host Services unless you are actually using the Host Services.
    • Do not use, copy, display, mirror or frame the Airbnb Platform, any Content, any Airbnb branding, or any page layout or design without our consent.
  • Honor your legal obligations.
    • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
    • If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
    • Read and follow our Terms, Additional Legal Terms, Policies and Standards.
    • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.
    • Do not use the name, logo, branding, or trademarks of Airbnb or others without permission, and only as set forth in our Trademark Guidelines.
    • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo or other source identifier that is confusingly similar to any Airbnb trademarks, logos or branding. See our Trademark Guidelines for additional details.
    • Do not offer Host Services that violate the laws or agreements that apply to you. Do not offer or solicit prostitution or participate in or facilitate human trafficking.

11.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Airbnb. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to Airbnb. If you reported an issue to local authorities, Airbnb may request a copy of that report. Except as required by law, we are not obligated to take action in response to any report.

11.3 Copyright Notifications. If you believe that Content on the Airbnb Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

12. Termination, Suspension and other Measures.

12.1 Term. The agreement between you and Airbnb reflected by these Terms is effective when you access the Airbnb Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

12.2 Termination. You may terminate this agreement for any reason and at any time by sending us an email or by deleting your account, or in the case of Experiences, by removing all of your Experiences from the Airbnb Platform. Airbnb may terminate this agreement, stop providing access to the Airbnb Platform, deactivate your account, remove your Listing(s), or any combination thereof, for any reason (including if your account has been inactive for more than two years) by providing you 30 days’ notice via email or using any other contact information you have provided for your account. Airbnb may also terminate this agreement, stop providing access to the Airbnb Platform, deactivate your account, remove your Listing(s), or any combination thereof, immediately and without prior notice if (i) you materially breach these Terms or our Additional Legal Terms, or Policies, (ii) you materially fail to comply with the standards and requirements for Experiences; (iii) you violate applicable laws, or (iv) such action is necessary to protect the personal safety or property of Airbnb, its Members, or third parties (for example in the case of fraudulent behavior of a Member).

Airbnb reserves the right to change our services, including to add or remove features and functionalities or change the types of Listings we accept or allow on the platform, including but not limited to: improve or update our services, prevent abuse, or respond to legal requirements. If we make material changes, we will provide you with 30 days’ advance notice, unless the changes are to prevent abuse or respond to legal requirements.

12.3 Member Violations. If (i) you breach these Terms, our Additional Legal Terms, Policies, or our Standards, (ii) you violate applicable laws, regulations, or third-party rights, (iii) you provide Content that is illegal or incompatible with these Terms, (iv) you have repeatedly received poor reviews or Airbnb otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly canceled confirmed bookings or failed to respond to booking requests without a valid reason, or (vii) such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, or third parties, Airbnb may:

  • suspend or limit your access to or use of the Airbnb Platform and/or your account;
  • suspend, remove, disable access to, or restrict visibility of Listings, reviews, or other Content;
  • cancel pending or confirmed bookings; or
  • suspend or revoke any special status associated with your account.

In case of non-material breaches or where otherwise reasonable, you will be given reasonable notice of any actions that Airbnb proposes to take and an opportunity to remedy the non-material breach (if it is capable of remedy), unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws.

12.4 Legal Mandates. Airbnb may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, including the measures described above in Section 12.3.

12.5 Effect of Termination. If you are a Host and terminate your Airbnb account, any confirmed booking(s) will be automatically cancelled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Listing’s cancellation policy as specified on the Listing at the time of booking. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the Airbnb Platform has been limited, or your Airbnb account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Airbnb Platform through an account of another Member.

12.6 Survival. Sections 1, 2.1, 3, 4.2, 4.3, 5.2, 5.4, 5.5, 6.1, 7, 8, 9, 10, 11, 12.3, 12.4, 12.5, 12.7, 14, 15, 16, 17, 18, 19, 20, 21 and 22 survive expiry or termination, together with any other terms that, by reasonable implication or to give them efficacy are, or are intended, to be performed in whole or in part after the expiry or termination of this agreement.

12.7 Appeal. If Airbnb takes any of the measures described in this Section 12 you may appeal such a decision by contacting our customer service.

13. Modification of these Terms.

Airbnb may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of any material changes by email, notifications through the Airbnb Platform, messaging service, or any other contact method made available by us and selected by you at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Airbnb Platform will constitute acceptance of the revised Terms.

14. Resolving Complaints and Damage Claims.

14.1 If a Member provides valid evidence that you, your guest(s), or your pet(s) have culpably:

(i) damaged the complaining Member’s, or the Accommodation owner’s (where the Accommodation owner is not also the Host), real or personal property, or real or personal property the complaining Member is responsible for, or has an economic interest in;

(ii) caused loss of booking income for bookings via the Airbnb Platform or other consequential damages which result directly from the damage caused under (i) above; or

(iii) otherwise caused the complaining Member to incur cleaning costs in excess of the Member’s cleaning fee (each of (i), (ii), and (iii) being a "Damage Claim"),

the complaining Member can notify Airbnb and/or seek compensation through the Resolution Center. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Airbnb and Airbnb reasonably determines that the Damage Claim is valid and you are responsible for the Damage Claim, Airbnb via Airbnb Payments can collect the amount of the Damage Claim from you.

14.2 If the Host and Guest cannot resolve, or a Guest fails to pay a Damage Claim, the Host may notify Airbnb through the Resolution Center under the terms of the Host Damage Protection Terms and seek compensation. Airbnb will review the Damage Claim and ask the Host to provide any required evidence (e.g. through appropriate documents, photos, invoices, or third- party experts) which substantiates the Damage Claim and the Damage Claim amount. The Guest will be given the opportunity to respond and provide any relevant counter evidence. If Airbnb reasonably determines, under (i) consideration of the evidence provided; (ii) the Host Damage Protection Terms; and (iii) applicable statutory rules on the burden of proof, that the Guest is responsible for the Damage Claim, Airbnb (via Airbnb Payments) will pay out the Damage Claim to the Host. If Airbnb pays out the Damage Claim to the Host, Airbnb may collect the amount of the Damage Claim from the Guest, including by charging the Guest’s Payment Method up to a maximum amount of $500 USD. Airbnb may also pursue claims for recovering Damage Claims amounts, including amounts exceeding the maximum amount applicable for charging the Guest’s Payment Method, against a Guest using any remedies it may have available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against a Guest. Members may appeal a decision by Airbnb by contacting our customer service. As between Members and Airbnb, the burden of proof regarding the Damage Claim and the Damage Claim amount always lies with Airbnb.

14.3 You agree to cooperate in good faith, provide any information Airbnb requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

14.4 Any decisions made by Airbnb in relation to a Damage Claim will not affect your contractual or statutory rights.

      15. Airbnb’s Role.

      We offer you the right to use a platform that enables Members to publish, offer, search for, and book Host Services. When Members make or accept a booking, they are entering into a contract directly with each other. Airbnb is not and does not become a party to or other participant in any contractual relationship between Members. Airbnb is not acting as an agent for any Member except for where Airbnb Payments acts as a collection agent as provided in the Payments Terms. While we work hard to ensure our Members have great experiences using Airbnb, we do not and cannot control the conduct or performance of Guests and Hosts and do not guarantee (i) the existence, quality, safety, suitability, or legality of any Listings or Host Services or (ii) the truth or accuracy of any Listing descriptions, Reviews, or other Content provided by Members. You acknowledge that Airbnb has the right, but does not have any obligation to monitor the use of the Airbnb Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Airbnb Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Member Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Where we remove or disable Content, we will notify a Member and provide the reasons for such a measure, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. You may appeal such a decision by contacting our customer service. Members agree to cooperate with and assist Airbnb in good faith, and to provide Airbnb with such information and take such actions as may be reasonably requested by Airbnb with respect to any investigation undertaken by Airbnb regarding the use or abuse of the Airbnb Platform.

      16. Member Accounts.

      You must register an account to access and use many features of the Airbnb Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Airbnb Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You must immediately notify Airbnb if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. You are responsible and liable for activities conducted through your Airbnb Account, unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials). If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

      17. Warranties.

      We do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or third party. To the maximum extent permitted by law, we do not warrant the performance or non-interruption of the Airbnb Platform and we do not warrant that verification, identity or background checks conducted on Listings or Members (if any) will identify past misconduct or prevent future misconduct. Any references to a Member or Listing being "verified" (or similar language) indicate only that the Member or Listing or Airbnb has completed a relevant verification or identification process and nothing else. We are not responsible for outages or disruptions of the Internet and telecommunications infrastructure which are beyond our control and can lead to interruptions in the availability of the Airbnb Platform. Airbnb may, temporarily and under consideration of the Members’ legitimate interests (e.g. by providing prior notice), restrict the availability of the Airbnb Platform or certain features thereof, if this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the Airbnb Platform.

      18. Limitations on Liability.

      To the maximum extent permitted by law, no party, including Airbnb’s affiliates and personnel, or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content, will be liable for any incidental, special, exemplary or consequential damages. Incidental, special, exemplary or consequential damages include, to the maximum extent permitted by law, lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services. Neither is Airbnb liable nor any other party liable, to the extent permitted by law, for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Airbnb Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Airbnb Platform, or (iv) the publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Airbnb has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

      Except for (i) Airbnb’s obligation to transmit payments to Hosts under these Terms, (ii) Airbnb’s obligation to make payments under the Airbnb Host Damage Protection, which contains its own limitations of liability, and (iii) Airbnb’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall Airbnb’s aggregate liability for any claim or dispute arising out of or in connection with these Terms, interaction with any Members, or use of or inability to use the Airbnb Platform, any Content, or any Host Service, exceed: (A) to Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) to Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.

      Except in the case of a Member’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall a Member’s liability to Airbnb or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content for any claim or dispute arising out of or in connection with these Terms, interaction with any Member, or use of or inability to use the Airbnb Platform, any Content, or any Host Service exceed: (A) in the case of Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) in the case of Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.

      19. Indemnification.

      To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb’s option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies or Standards, (ii) your improper use of the Airbnb Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in an Experience or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your negligence or breach of a contractual obligation or, to the maximum extent permitted by law, the negligence and breach of a contractual obligation by those third parties for whose acts and omissions you are responsible under Sections 3.1 and 5.4 above.

      20. Contracting Entities.

      Based on your country of residence or establishment and what you are doing on the Airbnb Platform, Schedule 1 below sets out the Airbnb entity with whom you are contracting. If we identify through the Airbnb Platform, an Airbnb entity other than the one set out on Schedule 1 as being responsible for a product, feature or transaction, the Airbnb entity so identified is your contracting entity with respect to that product, feature or transaction. If you change your country of residence or establishment to a country outside of Australia, the Airbnb company you contract with and the applicable version of the Terms of Service will be determined by your new country of residence or establishment, from the date on which your country of residence or establishment changes.

      21. Applicable law and Jurisdiction.

      These Terms are governed by and construed in accordance with Irish law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. As a consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Irish courts.

      22. Miscellaneous

      22.1 Other Terms Incorporated by Reference. There are documents, policies and standards referred to in and linked from these Terms (including on our Additional Legal Terms page), which apply to your use of the Airbnb Platform, which are incorporated by reference to these Terms, and form part of the binding legal agreement between you and Airbnb.

      22.2 Interpreting these Terms. Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms (including those items incorporated by reference) constitute the entire agreement between Airbnb and you pertaining to your access to or use of the Airbnb Platform and supersede any and all prior oral or written understandings or agreements between Airbnb and you. This Section does not exclude a party’s liability for prior false, misleading or deceptive statements or misrepresentations, where oral or written. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and Airbnb. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise indicated in Section 23.12 below, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

      22.3 No Waiver. Subject to any limitation expressly stated in these Terms, or any document policy or standard incorporated into them, neither Airbnb’s or a Member’s failure to enforce any right or provision in these Terms will constitute a waiver of such right or provision unless acknowledged and agreed between the relevant parties in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

      22.4 Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations hereunder without Airbnb's prior written consent (not to be unreasonably withheld or delayed). Airbnb may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice. Your right to terminate this agreement at any time pursuant to Section 12.2 remains unaffected.

      22.5 Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by Airbnb via email, Airbnb Platform notification, messaging service (including SMS and WeChat), or any other contact method we enable you to provide. If a notification relates to a booking or Listing in Japan, you agree and acknowledge that such notifications via electronic means in lieu of a written statement, satisfies Airbnb’s obligations under Article 59 (1) of the Japanese Housing Accommodation Business Act.

      22.6 Third-Party Services. The Airbnb Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Airbnb is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

      22.7 Google Terms. Some translations on the Airbnb Platform are powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and non-infringement. Some areas of the Airbnb Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

      22.8 Apple Terms. If you access or download our application from the Apple App Store, you agree to Apple’s Licensed Application End User License Agreement.

      22.9 Airbnb Platform Content. Content made available through the Airbnb Platform, including without limitation trademarks, trade dress, inventions, algorithms, computer programs (in source code and object code), customer and marketing information and other content (“Platform Content”), whether registered or unregistered, may be protected by copyright, trademark, patent, trade secrets, know how, and/or other laws of the United States and other countries. You acknowledge that all intellectual property rights for that Platform Content are the exclusive property of Airbnb and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Platform Content accessed through the Airbnb Platform except to the extent you are the legal owner of that Platform Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, Airbnb grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Platform Content made available on or through the Airbnb Platform and accessible to you, solely for your personal and non-commercial use.

      22.10 Airbnb.org. Airbnb.org is a nonprofit corporation exempt from income taxation under U.S. Internal Revenue Code Section 501(c)(3), operating as a public charity. Airbnb.org is not owned or controlled by Airbnb. Airbnb.org administers a number of charitable programs that benefit our Host and Guest communities and the public.

      22.11 Force Majeure. As between Airbnb and a Member, neither shall be liable to the other for any delay or failure to perform resulting from abnormal or unforeseeable circumstances outside their reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials. For the avoidance of doubt, this Section does not: (i) apply to a Reservation, which is subject to the Host’s cancellation policy and the Extenuating Circumstances Policy; or (ii) operate to extend deadlines applicable to a Resolution Centre Request, a Host Damage Protection claim, an Aircover for guests claim, a Reservation Issue under the Rebooking and Refund Policy, or an Experiences Issue under the Experiences Guest Refund Policy, or other requests, claims or reporting under similar policies that are incorporated by reference into these Terms.

      22.12 Emails and SMS. You will receive administrative communications from us using the email address or other contact information you provide for your Airbnb account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from us. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have an Airbnb Account.

        23. United States Dispute Resolution and Arbitration Agreement.

        PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT WHERE THIS ARBITRATION AGREEMENT APPLIES IN ACCORDANCE WITH SECTION 23.1, YOU AND AIRBNB AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.

        23.1 Application. This Arbitration Agreement only applies to you if your country of residence or establishment is the United States. If your country of residence or establishment is not the United States, and you nevertheless attempt to bring any legal claim against Airbnb in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 23 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

        23.2 Overview of Dispute Resolution Process. Airbnb is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms provide for a two-part process for individuals to whom this Section 23 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 23.3, below), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.

        23.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice") and attempt in good faith to negotiate an informal resolution of the individual claim. You must send your Pre-Dispute Notice to Airbnb by mailing it to Airbnb’s agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A Pre-Dispute Notice must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 23.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.

        23.4 Agreement to Arbitrate. You and Airbnb mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Airbnb Platform, Host Services, or any Content (collectively, “Disputes”) will be settled by binding arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to a Dispute, you and Airbnb agree that an arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 23, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved exclusively by an arbitrator.

          23.5 Exceptions to Arbitration Agreement. You and Airbnb each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in state or federal court in San Francisco, California, unless we both agree to some other location: (i) any claim or cause of action alleging actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; (ii) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g. imminent danger or commission of a crime, hacking, cyber-attack); (iii) a request for the remedy of public injunctive relief; (iv) any claim or cause of action for vexatious litigation; or (v) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

          23.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the AAA (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.

          23.7 Modification of Arbitration Rules - Arbitration Hearing/Location. In order to make the arbitration most cost-effective, efficient, and convenient, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed $1,000,000 USD shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds $1,000,000 USD shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is $10,000 USD or less, the parties agree to proceed solely on the submission of documents to the arbitrator.

          23.8 Modification of AAA Rules - Arbitration Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb will pay your share of any arbitrator fees.

          23.9 Modification of Arbitration Rules - Claims Brought for an Improper Purpose or In Violation of This Arbitration Agreement. Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous. As allowed by applicable law, the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.

          23.10 Arbitrator’s Decision. The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the ADR Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

          23.11 Jury Trial Waiver. You and Airbnb acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

          23.12 No Class Actions or Representative Proceedings. You and Airbnb acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

          23.13 Mass Action Waiver. You and Airbnb acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 22 and 23.12 of these Terms will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb from participating in a mass settlement of claims.

          23.14 Modification of Arbitration Rules – Mass Action Batching Requirements. If for any reason, notwithstanding Section 23.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 21 and 23.12 of these Terms.

          23.15 Modifications of Arbitration Rules - Offers of Judgment. At least ten (10) days before the date set for the arbitration hearing, you or Airbnb may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within thirty (30) days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.

          23.16 Severability. Except as provided in Section 23.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision will be severed and the remainder of the Arbitration Agreement will be given full force and effect.

          23.17 Amendment to Agreement to Arbitrate. If Airbnb amends this Section 23 after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject the change by sending us written notice no later than 30 days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 23. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to arbitration.opt.out@airbnb.com. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb.

            23.18 Survival. Except as provided in Section 23.16, and subject to Section 12.6, this Section 23 will survive any termination of these Terms and will continue to apply even if you stop using the Airbnb Platform or terminate your Airbnb Account.

            Additional Terms for Experience Hosts

            Nothing in this Additional Terms for Experience Hosts section (“Experience Host Terms”) should be interpreted to amend or contradict the Terms unless explicitly stated. If there is a conflict between the Terms and the Experience Host Terms with respect to an Experience, the Experience Host Terms control.

            24. Experience Host Terms

            24.1 Listing an Experience. To list an Experience, you must create a Listing and submit the Experience to Airbnb. Experiences must at all times meet the standards and requirements for Experiences. When listing an Experience you must, where applicable, fully educate and inform Guests about (i) any risks inherent or incidental to the Experience, (ii) any requirements for participation, such as the minimum age, related skills, or level of fitness, and (iii) anything else they may need to know to safely participate in the Experience (including dress codes, equipment, special certifications or licenses, etc.). Airbnb reserves the right to decide, in its sole discretion, whether a submitted Experience will be published on or remains on the Airbnb Platform.

            24.2 Hosting Airbnb Guests. Once your Experience is published on the Airbnb Platform, you will have the ability to add dates and times when you offer your Experience through the Airbnb Platform (an "Instance"). By making an Instance of your Experience available on the Airbnb Platform, you agree that only people who book through Airbnb can attend that Instance of the Experience. You further agree that you will not allow people to attend any Instance of your Experience available on the Airbnb Platform unless that person booked through Airbnb (or was added as an additional Guest for a spot booked through the Airbnb Platform).

            24.3 Social Impact Experiences. If you wish to provide an Experience that benefits a social impact organization (a "Social Impact Experience"), you and the benefitting organization must comply with the Social Impact Experience eligibility requirements. When listing a Social Impact Experience you (i) represent and warrant that you are duly authorized to act on behalf of the benefitting organization and (ii) acknowledge and agree that all payouts will be directed to an account owned by the benefitting organization unless the benefitting organization has obtained authorization from Airbnb as outlined in the Social Impact Experience eligibility requirements. You and the benefitting organization acknowledge that listing a Social Impact Experience does not create a commercial fundraising or co-venturer, or charitable trust relationship with Airbnb, and Airbnb is not a professional fundraiser or commercial participator. If the benefitting organization is a nonprofit, the nonprofit, and not Airbnb, is responsible for determining what, if any, portion of its Total Price is a charitable contribution and for providing Guests charitable tax receipts for any applicable charitable contributions. You and the benefitting organization are solely responsible for complying with all laws that apply to the organization and your Social Impact Experience.

            24.4 Equipment. You are responsible for providing all equipment, including supplies, vehicles, venues and other materials ("Equipment") necessary to host your Experience. You are solely responsible for ensuring that the Equipment used in your Experience is in good working order and conforms to all laws pertaining to safety, equipment, inspection, and operational capability. Except as otherwise required by law, you assume all risk of damage or loss to your Equipment.

            24.5 Additional Experience Host Responsibilities. You are responsible for (i) understanding and complying with all laws, rules and regulations that may apply to your Experience, (ii) obtaining any required licenses, permits, or registrations prior to providing your Experience; and (iii) ensuring that your Listing and/or Hosting of an Experience will not breach any agreement you may have with any third party. You can find additional information about some of the legal obligations that may apply to you on our Responsible Hosting pages.

            24.6 Hosting as a Team or Organization. You must provide your Experience in person and may not allow any third party to provide the Experience on your behalf, unless authorized by Airbnb. Any member of a team, business, or organization that interacts with Guests must be added to an Experience via the method designated by the Airbnb Platform. See Section 5.5 for information about hosting as part of a team, business or organization as well as the Listing Management Terms of Service, which are incorporated herein.

            24.7 Insurance. We may require that you obtain your own insurance in order to publish an Experience on the Airbnb Platform. We will provide you with reasonable notice of any changes to insurance requirements that apply to your Experience. In such cases, you agree to obtain and maintain insurance for you, the members of your team or organization, and/or your Experience with the coverage and in the amounts determined by us in our sole discretion for any and all activities that take place on your Experience. You agree to cooperate with Airbnb to verify such insurance coverage. In the event that Airbnb has obtained its own liability insurance that covers your Experiences, your insurance will be the primary source of coverage and Airbnb's insurance will operate as excess or secondary insurance for any amounts exceeding your coverage. Our procurement of such secondary insurance coverage does not relieve you of your obligation to obtain insurance in amounts required by us.
